Post Bankruptcy Advice - CCJ's

Hi

I declared myself bankrupt in August 2009 and was discharged a year later. Recently I have been trying hard to improve my credit file. I have managed to get all my debts marked as satisfied although a couple of the dates are wrong, I'm still working on that.

What I really need some help with is CCJ's, I have 5 all dated before the bankruptcy but none of which say satisfied. I have called the courts that issued them and they were not much help to be honest, they told me to contact the OR, which I did who told me to contact the court and so on.

Has anyone managed to get CCJ's marked as satisfied after bankruptcy or is it a case of waiting for them to drop off once the 6 years is up. If you have managed to do it could you please let me know what I need to do.

I assume that this is the right thing to be doing it may be that this will make no difference weather they say satisfied or not, if you think i am wasting my time please let me know.

    Marking CCJs as satisfied falls under the Register of Judgments, Orders and Fines Regulations 2005 rather than anything to do with data protection and the ICO as is the case with defaults.

    When it comes to marking CCJs as satisfied that quite specifically states that:
    “satisfied”, in relation to a debt, means that the debt has been paid in full, and “satisfaction” is to be construed accordingly;

    So accordingly most courts will not mark a CCJ included in a BR as "satisfied" or issue a certificate of satisfaction.

    Sometimes you can blag it, but most of the time the courts stick to the letter of the law and regulations.

    Ultimately it's not a huge deal, as the bankruptcy on your credit file is a bigger blacker mark than any prior unsatisfied CCJs, and the BR will be on there longer.

  • Can I also just ask a question regarding the debts on my credit report?

    I have managed to get all debts marked as settled there are two on the report where the default is dated one month after the date I became bankrupt. Do you think this is an issue should i try to get it changed?

    It's not technically correct, and will mean that those defaults/debts will remain on your report for a month longer than they should do.

    Depends really how much you think that will matter to you when these things are dropping off in 2015, and consequently whether it's worth the bother trying to get them corrected? In the end that is your judgement call based on your circumstances, or what you think they will be then.
