i was sent a letter from my choice catalogue recently offering me a mobile phone as a free gift when i placed an order of £50 or more. they said it was because they had missed me so much and was hoping i would come back. anyway i placed order for £70 russian wedding ring, and the phone arrived 2 days later. was quite impressed actually very slim and a camera phone. anyway the ring is too small need maybe bigger size. plus it seems very thin less than 3mm each band. i now want to return it and get a thicker one in a bigger size elsewhere. question is do i now need to return the phone as well. the leaflet did not mention anything. what are your experiences?

Legally I haven't got a clue!!
But wouldn't this be a good Moral Dilemma Poser for Martin to stick on the weekly e-mail??0 -
No I don't think you have to, to be on the safe side though don't use it until your account is credited with the returned item. And if it isn't in the small print on the letter then you definately don't have to.0

I thought legally if they actually described something as FREE then they were not able to reclaim it or imply a charge to keep it?0

Yeah but its free WHEN you BUY something over a certain amount so I reckon the phone will have to be returned (it's like the 2 go together) but if nothing is said about it in the small print...they haven't got a leg to stand on;)You may walk and you may run

Hi,
I work for the catalogue company and if your buying a replacment item then you will be entitled to keep the mobile phone for free as the gift.
hope this helps
