You instructed your bank to cancel a continuous payment authority. The bank failed to do so. They therefore refunded the unauthorised transaction - AS THEY ARE REQUIRED TO DO BY LAW. (See regulations 55&61 of the Payment Services Regulations 2009)
Nothing fraudulent has occurred here.
You can tell Minicredit, with confidence, to swivel on that daft argument. They are just deflecting from the matter at hand.

I think what I did was about a week before I was going to default I posted a message to them on their actual website, I think their was a help section on the website and somewhere to send any messages to them. I too was locked out after I defaulted so I couldn't check what was going on. I think in my emails from them a few months later I think they said I should have sent to collections email address. I was pretty gutted about it all, because I thought I did the right thing to let them know I was defaulting and I didn't want to phone them.
I have heard over the past year they do this a lot and there are loads of complaints about their charges. Even if I should of sent to collections surely they should have replied back to my original message I sent them. I think it would be a good idea to get some advice on this. What they do is they keep trying to take the money and charge you each time they try. I didn't know this was legal but in their emails they kept quoting this would happen in their contract.0 -

The OFT's guidance on debt collection says charges must be reasonable and somewhat reflect a creditor's actual costs.
Your debt going up to £2,400 is ludicrous and there's no way it would stand up on court.
There are new guidelines being discussed where these companies will only be able to take the full amount from your account.
Even with the current guidelines though, it would be hard for them to justify why they continually tried to take money from you without discussing the matter with you.What will your verse be?

I was going to pursue this further with the OFT, but having family troubles and feeling depressed at start of this year so I have not done so as yet. I did send them some emails to say I would get to the OFT, I might be wrong but I think you have to wait for a certain number of weeks after you have made the complaint. I think maybe I will look into this further because the charges they have added on are appalling and when OPOS took over the debt I said I was in dispute with MiniCredit and have told my DMC StepChange this too. Like I said before I have heard this is what MiniCredit seem to do.0 -

The 8 week wait applies to referring complaints to the FOS - I think you are free to complain to the OFT whenever you want.0
