Official Workplace & Scottish Bank Holidays

This isn't something I'm looking to pursue, I am simply curious...

My contract states that my official place of work is in Edinburgh - it says this for all colleagues, regardless of whether we work there or not. In my case, I do not (I work outside of Scotland).

Given this location listing in my contract - could I take the additional Scottish bank holiday in January? Our colleagues who actually work in Edinburgh will.

Do the Scottish based staff get the English bank holidays too?

Possibly, but then you'd have to give up one of the English Bank Holidays at Easter (can't remember off hand which one isn't taken in Scotland) and you might have to take your August Bank Holiday at the start of the month rather than the end. You're not going to gain anything if that's what your hoping for, as the number taken is the same in Scotland and England. Northern Ireland is where you want to be as they may get an extra day (just checked the list and it's actually two, St Patrick's Day and Battle of the Boyne) although the legal minimum leave allowance is still 28 days as in the rest of the UK.

They may be different days, but Scotland get one extra bank holiday over England and Wales and (as far as I know) our colleagues working in Scotland get the same number of holiday days outside of bank holidays.

What does your contract say about holidays? does it say x days per year or does it say x days plus bank holidays per year?

"Holiday entitlement (excluding Bank Holidays)..."

Then
"
Bank Holiday entitlement, based on a 35 hour working week, is as follows:

• Colleagues working in England and Wales are entitled to 8 days Bank Holiday (56 hours).
• Colleagues working in Scotland are entitled to 9 days Bank Holiday (63 hours) which includes the 2nd January...."

Isle of Man get 10!!

Doubt it when I worked for a Scottish bank in Scotland I got English bank holidays as the department I worked for served the English market. I actually found it handy as got a few 'quieter' bank holidays!

Looks like you have answered your own question, you work in England so are entitled to 8 days bank hols.

Scottish banks switched to using English bank holidays in the 1990s because it was becoming increasingly difficult to operate IT systems, and the processes such as BACS and cheque clearing that fed into them, for different sets of bank holidays, so the fact your department served the English market was not really relevant (although there were some local agreements where some branches would open for shorter hours and with less staff on Scottish-only bank holidays).

I didn't even know we had offices there, I doubt they're offices for my profession either!
