Good morning all.
I have recently received a letter from scotcall informing me of 2 debts with Halifax bank from 2003 and 2007
They were both joint loans taken out with my now ex-wife.
I paid one of them for a number of months until things went wrong and i could not longer afford to pay the agreed amount.
Scottcall have threatened me with door stop collection. And i am worried as i am only lodging at the moment.
I logged onto credit expert and have got my credit rating, and details of the debts, so this is how i know the dates.
Does statute barred go by the date i stopped paying the instalments or from the date i initially started the account?
I am so worried right now about it all, so any help would be a great help

stat barred starts on the last date you acknowledge the debt either in writing or by making a payment so for them both to be stat barred your last acknowledgement needs to have been before 1/11/07The only people I have to answer to are my beautiful babies aged 8 and 50

Do you know if your ex has made any payments, or written acknowledgement in the past 6 years?0

OK thanks, so one of them is definalty statute barred, the other one will be 6 years since we took the loan out but we did make payments on that one. Is there a way of finding out about when last payment was made.
With the subject of them calling at my current lodgings, is this something they will do or is it one of the empty threats that Lowell tried a few years ago. If they do turn up what can I do to be them to go away.
I was thinking about the letter of statute barred but if onne of the loans isn't statute barred, sending a letter claiming it is would start the 6 years again wouldn't it??

You can tell them to fornicate off, they have no more rights or privileges than you or I have, you do not have to speak to them, you do not under any circumstances allow them into your home, send them a letter, to be found here in the stickies somewhere, removing there rights of implied access to your property, they cant legally visit you without an appointment, tell them you have no wish to make such an appointment, if they call at your door, call the police and report them for trespass, they have no powers whatsoever and can do nothing to you, there use is intended to harass you into paying.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. But i am guessing if i send them a letter telling them about the kaws of the land ect, then isnt that deemed as contact with them regarding the debt. and then the 6 years start again??
So what i am hearing so far. Is not to worry about them, ignore them when/if the turn up

The standard letter tries hard not to count as an acknowledgement.

But ideally you need to be sure of your facts before you declare it statute barred. (If there has ever been a 6-year period of no acknowledgement, then it is SB and cannot be 'un-barred')
Or else hold that as a defence if they ever start a court claim, and ignore them in the meantime.0 -
each debt should have its own reference code so send the letter only with the reference code for the one that is stat barred and ignore the other one
