VCS reject appeal

Hi, vcs rejected my appeal twice and have sent me the POPLA form,
firstly here are the grounds for their invoice
I suffered an angina attack and did not have my gtn spray with me, I asked a passer-by if there was a medical centre near, he pointed in a direction which I drove to stopped the car put my blue badge on the screen and sought medical help, I could not find any centre, so I sat down until I recovered and returned to the car, only to find it was private clear way, which I received a ticket from VCS, I suffer from ischemic heart disease and sent a medical certificate signed by my GP with my appeal to vcs, since this ticket my condition worsened and was admitted last week for another angioplasty put these people don't care and say if I appeal to popla and lose I will have to pay the full amount and costs incurred, any advice would be grateful

  • Never heard of a private clearway. I wonder if they are ticketing on a councilroad, worth checking out.

  • Aaaaannndd relax.

    Nope, this is winnable at POPLA but you won't primarily be using the mitigating circumstances that you mention above - if you do, POPLA will find in favour of VCS.

    You need to concentrate on GPEOL and contract with landowner - these win every time. Read some recent threads as the majority cover both these points. Then come back here and ask specific questions. And don't submit your POPLA appeal without posting it here first for feedback.

    If it was an Airport then search the forum for the word Airport as this has been discussed to death several times over and you'll find all your questions answered in other VCS Airport threads.

    sorry it was a restricted area which stated "vehicle parked on a clearway" the signs on site clearly state no parking or waiting at any time, (their words) they then go on to say that there was a medical centre on the street I parked on and I should have seen it and obtained treatment for my ailment ??, they wanted proof I visited a medical centre, I couldn't see one ? could some direct me to what I should be reading as stated above?

    Obviously you read the wording that wins at POPLA. :)

    and you will lose if you say this:

    None of that will win you a POPLA appeal. Our versions work so come on, wise up and read them. There's a pattern to the links, the wording is similar!

    I am reading them but not quite understanding what I should appeal against, I fairly understand the contract bit and that VCS do not own the land and that it is unlawful and against the code of practice, but which part applies to me and what do are my grounds for appeal please?
