Help with finding correct court forms - Liability orders

Morning,

Unfortunately I closed a retail business in January 2012.

I have both business rates and council tax debt and have been issued with a liability order on both from the Magistrates Court. I have regular visits from the bailiffs.

On the last business rate bailiff visit, as I closed the door he forced entry and a two hour stand off took place. He wanted £1000 on the door and £600 per month in repayments.

I would like to go back to court and put in place a realistic payment plan for both debts using my new incomings/outgoings expenditure as my husband has now secured employment.

I have contacted the local council who have said to call the magistrates court, the magistrates have suggested the council. Ive done lots of searching online and have the forms if it were a County Court case but Magistrates appear to be different.

Could anyone offer any assistance

Regards
Becky

you cant go back to court to set a realistic payment for council tax debt or your NDR once the liability order is granted the court has no further involvement

I second the previous post - once the liability order has been granted the court have no say in any re-payment and cannot order a payment arrangement unless you appear in front of a magistrate for committal to prison.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
