CSA non payment

Hi can anyone help with this please?! I have a claim with the CSA for my ex partner who works offshore. He used to work a 2 week on / 2 week off rota and made payments via his employer as refused to pay maintenance for 18months. Once the CSA claim went through he decided to work ad-hoc as he could afford not to work, therefore, reducing the number of payments he needs to pay. I have recently found out that he has apparently given up work (or been sacked for non-attendance I'm not sure). Having not made any payments through the CSA all summer I then got a lump sum of around 8 weeks worth. Now nothing since September. The CSA told me his employer have not informed them his contract has been termimated. I have read that the CSA can force payment or take payment from his bank account but I'm wondering in what circumstances if anyone knows? He has a large amount of money in his account and a house with a lot of equity in. He has also so far been on holiday at least 6 times since May this year. I think it's very unjust that he tells our son he can't afford to buy him a coat or shoes as he gives me all his money (not a penny) yet can afford to live a very high flying lifestyle - none of which is on credit, he has no debt at all - while our son has to do without basics until I can save for them on my wage while also running a home. It makes me so sad that he constantly blames me - via our 10 year old son - for not being able to ends meet even though I work full time and am trying to catch up on mortgage arrears and other bills caused by him walking out and stopping his payments towards the household. Do the CSA have any powers that can help at all?? Any advise would be greatly appreciated :cry:

  • If he has been sacked or simply given up work we cannot assess him from the effective date fo this change, what confuses me is we told you the employer has not told us his contract has been terminated, how often is he paid? Strange to get 8 weeks worth or maintenance in a lump sum, im assuming hes on a DEO if hes been non-compliant for 18 months, You need to ring us and ask what method of collection hes on, If hes still employed, and if there is a reason why the payments have no arrived such as a change of circumstances.

    You should have been sent a collection sceduele before you recived any payments, what dates are you supposed to be paid on? Monthly/weekly? ect, You need to clarify all this.

    Many thanks for the reply! As the payments come from his employer to the CSA and he had started "ad-hoc" working I only ever receive payments when he has/had been to work. I received 8 weeks worth of payments on 1st October. I called CSA on this date and was told the money had come from his employer as usual and the employer had not notified it was a last payment. I don't have a payment schedule as such due to the nature of his work and the fact his employer only pays him/CSA when he works - grrrrrr!!

    I'll take your advice and call again, unfortunately though when I've called in the past I've just been told if he doesn't work he doesn't have to pay. Extremely frustrating while having to struggle yet watch his extravagant lifestyle! Hey ho!!
  • There right, If he simply doesnt work, no maintenance is owed, a strange case to be sure.

    This is only the case if the NRP applies for a supersession on ceasing work. If he fails to do this he continues to accrue arrears as the existing liability continues.

    to which on next contact he would explain the lack of work and the arrears would be wiped if evidence was provided.
