chased for mortgage shortfall what next BR

long story short after a seperation i had to hand the keys back on my home. voluntary reposession. i had no other option as couldnt afford and couldnt sell etc etc.
its now sold and theres a shortfall of around 25k. i cant afford to pay 25k. its in joint names but my ex no longer work really so i am told i will be chased for this...
i have spoken to a debt advisor as rates etc also are arounfd 2k outstanding.
what do i do next.
if i pay £600 to declare myself bankrupt will this disappear........i take it my bank account will be frozen so i will clear anything i have. i am told i can then open a basic account with co op or barclays for paying bills by direct debit and getting my wage paid in. finally i am in a trade union at work UNITE or GMB i think again i am told they may help with the fees.....
really starting to worry now as all above getting on top of me as if i dont have enough with the seperation and custody issues with my kids..........
any help or advice greatly appreciated....

    what do i do next. Well you could certainly apply for BR but we can't advise it as we don't have your full facts. You need to speak to someone like National Debtline, StepChange or the CAB. If they suggest BR then we can help and support you through the process.

    Yes I believe some unions will help with fees so do ask them. The fee is £700

  • i now have an appointment set up with debt action ni. i have previously met with them who advised me for the voluntary repossesion...
    after reading the letter from santander the say they are passing the shortfall to a shortfall company who will be in touch with me to fill out a budget plan. and not to contact them until then.
    however sanatander / abbey had a budget planner attached to the letter. i filled it it but will not send it off just yet as it wasnt asked for......my worry is they asked for my last 2 wages slips. last few months i have been working my nuts off doing all overtime i can for xmas and kidss school uniforms and fees etc. this overtime isnt always available. also as i am starting from scratch in a new rented home with new partner. ive had to save to buy the lot,beds sofas,tv,fridge,freezer,washing machine,cooker,tables etc as ex took the lot from old home for her and kids........all this costs hence working my nuts off............
    roughly from my budget planner to what i hace taken home with all this overtime last two months theres a surplus of around 300 per month.......if i do a falt month no overtime as said its not always available i would be lucky to break even infact may be less than outgoings.... i.e outgoings per month 1600 earn 1300 flat overtime 1900?
    also forgot to mention apart from house shortfall rates my ex also ran up around 15k on store and credit cards in my name which also i am chased for, i did manage to get them off my backs with the prove it letters i got on here tho they just pass it to another debt agency and then i start sending them the prove its again......

    the wage slips are a big worry to me as said working my nuts off for a reason.......last few months are not normal standard earnings....

    i will open standard bank account now will it be ok with the extra money i have in it to get me started in my home or can they touch it...wot bank would u recommend co op or barclays?

    Should be OK with Barclays I think.

    If me, I wouldn't bother filling in creditor forms or sending info you don't want to if you are never going to be able to pay this off. Should be token payments or just nothing, and they can lump it if they don't like it.

  • if i fill out the form for this company will they still persue if they see i cannot pay anything. i.e at the minute my outgoings out weigh my incomings except when i do a lot of extra overtime which isnt always available as said........
    it worries me they can see my bank statement and see my last few pays and base repayments of that. after xmas i will be back to normal working hours so dropping £400 or so a month...........
    approx outgoings 1600. pay standard 1300 pay with overtime 1900 max.

    what will happen next?
    do i go declare myself BR or wait until they chase me for the money. it is in joint names the 23k shortfall however my ex never paid towards this ever and only works part time now min wage ?
    really dont know what to do and waiting on a free appointment with debt advisor . just hope to get some answers or peace of mind on here please?????????????????????????????????????

    If you ignore they will just chase you and harass you and them pass the debt on and they will chase and harass you and then they will pass the debt on and they will chase you and harass you. One of them may go to court to get a ccj at some point and then when you don't pay that they'll send bailiffs.

    How do you survive each month if you spend more than you earn?

  • at minute im workin all hours i can so those months ive around £400 spare. also my new partner works fulltime and helps out with stuff...
    id rather not ignore but dont no wot to do.
    will they persue and will they base it on my overtime months as they will end in new year????
    only asset so to speak i have is a 10year old car worth about £800 i need for getting to work for the 60 mile trip ?

    They will base it on any information you give them. If you have no money left after your reasonable outgoings have been taken in to account then they can't get blood out of a stone but they can keep harassing you. They may accept a token £1 payment in the hope your situation improves.

    Do you have any problems with declaring yourself BR as you have no assets?
