would I be able to get some one to review this letter to baliff?

As a baliff has placed a levy on our caravan (which is our only home), the nationa debtline advised us that its invalid and to put this in writing. I have written this letter to the baliff, if you could give it a once over and your opion about it, that would be great. Thanks in advance. (I have put X for privacy sake, but those details will obviously be put in before we send it.)


Further to our telephone conversation today, my wife and Ihave been in contact with National Debt line and they have advised us tocommunicate with yourself and Bristow & Sutor only in writing. We would request that you only communicatewith us in writing as well. Please beaware that any attempt to contact us via telephone will be ignored. Please be advised that should you visit us onour property we will not grant you access to our home under any circumstance.
National Debt line also advised us that the levy you haveplaced on our caravan is invalid as that is our place of residence. I refer you to (here is the national debtline website address but its a link so I didn't want to put it here)

“The regulations also say thatthe following items are exempt and cannot be taken…such clothing, bedding, furniture, household equipment and provisionsas are necessary for satisfying basic domestic needs of the person and family”.
We would rightlyargue that the very roof over our heads is necessary for satisfying basicdomestic needs. If you do not removethis levy, we will complain to the relevant parties.

As for the outstanding council arrears, we fully intend topay this completely. In order for you tounderstand our financial circumstances we have included a budget of ourexpenses, a copy of X wage slip, a bank statement to prove to you that we areonly able to offer you X at the current time. We have also included a proposed payment schedule for the payment of ourarrears. We hope you find this satisfactoryas we are unable to offer more, as you can see from our budget.

Like you, we want to have these arrears paidoff as soon as possible. Unfortunatelywe are not in the position to be able to borrow money to pay off this debt. Weawait your response.

    Looks ok, just the bit mentioned above, I think you should change :
    "we will complain to the relevant parties."
    and replace it with the jist of the info here :

    Complaining to the local authority about council tax bailiffs

    Your local authority should have a policy about how the council tax bailiffs should behave and what they are expected to do. For example, there may be a policy about what repayment arrangements the bailiffs should accept or how long the bailiffs should try to get back money for a council tax debt before they give up.
    If you think the bailiffs are behaving unreasonably, ask the local authority for a copy of their policy on collecting council tax arrears. If the bailiffs aren’t following the policy properly, you can make a complaint through the local authority complaints procedure or speak to your local councillor.

    I think you need to be more specific.

    Thanks, I've changed it to:

    "If you do not remove this levy, we will complainto the X Council and the Local Government Ombudsman."

    According to National helpline I can also complain to the magistrates court as well but I don't want to add that as they said that that would be a last step and if we did take them to court if we lose we would have to cover costs. So Im a bit hestitant to include it.
