  • I had this letter also, but am confused . . I went bankrupt in 2008 and my northern rock loan was included . Am I right that I am safe from being chased for this now no matter who bought the loan?

    Thanks for comments, Mortimer Clarke Solicitors (apparently a desk at Marlin HQ!) letter arrived today, balance owing seems to not have any extra charges added and states clearly that I will be able to repay by 'affordable instalments'. I have no intention of phoning them as they advise, everything in writing. Intend to be wary of this lot as there are many posts all over the internet regarding heavy handed tactics. Confused just like previous writer though concerning what has happened to charging order/restriction that is registered with Court and Land Registry as from Northern Rock. As they have transferred or sold the loan does the charging order become part of the package, obviously restricting them from threatening that particular course of action again if no agreement can be reached? Head spinning a bit here, very grateful for same help needed as Joomoomies

    I am in a similar position, I have sent a letter to Marlin stating that I only deal in writing and to send standing order details.
    I am of the believe that having purchased the debt the previous actions of NR are valid to them. So a CCJ or C/O transfers to them. You certainly can only have one CCJ for a given debt.
    My best guess with the request to phone them, is probably to harass thousands non payers or token payment payers. My only slight worry is they may become heavy handed with Orders For Sale, I doubt it though as the judiciary rarely grant these except in exceptional circumstances.It would seem that the process of transfer has been somewhat poorly thought out. We can only wait and see. From there perspective as debt purchasers they need to collect more debt than they paid.

    Yep, you are safe. Although you might need to tell the muppets in writing.

    I went BR in early 2009 and received the same letter, I called Marlin who were actually quite helpfull, I sent them an email with a copy of my court order. The lady blamed NRAM for all the confusion but stated the sum of 24k was on my account. I didn't sleep all that well last night but am pleased that someone can confirm that i'm not going to get chased for this.

    Nearly 5 year now after BR, i was thinking my Credit score would be getting a little better but it seems if debt like this is still under my name then i have no chance in the near future of a clean slate.
  • Maybe contact CAB if still on your credit file. Not sure what happens to the accounts on there after BR.

    I wonder if anyone can give me some advice. In 2000, I took out a £3000 loan with Northern Rock. After a short while, my job fell through and I fell behind with my payments. Northern Rock employed a DCA to collect my payments, which I made every month until 2004 when I received a letter from the DCA telling me to stop making future payments. I can remember phoning Northern Rock to ask what was going on, to be told by the operator that my account had been closed. I heard nothing more from them until 28th October 2013, when Northern Nock informed me by letter that my debt had been sold to Marlin. Today, 30th October 2013, I received a letter from Marlin asking for repayment of an outstanding amount of £2238. I honestly thought I had fully repaid this loan only to be contacted over 9 years after being told the account had been closed. Can anyone advise me please? P.S Sorry if I hijacked anyone's post.

    If not paid or acknowledged in writing fir 6 years, its statute barred. Meaning, they can ask you to pay but can't make you pay by getting a court judgement. They should leave you alone when told this.

    This is a great defence, even though you may have already paid it.
