Mortgage refused on ccj neither of us have!

My husband and I are in the process of buyingan investment buy to let property. We are actually going to rent it out to afamily member who will cover the mortgage.
However we have been refused by the lender onthe basis that we have a ccj. We do not have a CCJ and have never had one butwe have since discovered that there was a CCJ registered to our current addressin 2009-we bought the property in 2012. Can we be refused on this basis?
Interestingly, 2 months ago we very nearly sold our property to upsize & we were offered a mortgage of 450k, what we need now is only 125k.
We’re gutted as we’ve found a property that wereally like.

Lender, and or broker if you used one first but also getting a copy of your equifax and experian report just to be on the safe side would be a good idea too.Grab life by the balls before it grabs you by the neck.0

If you've never had a CCJ you need to get your credit reports through the main credit agencies and get thing changed. Advise them that the CCJ was linked to the previous occupant of the property you are in. I am sure they will be happy to help to rectify things. Good Luck...0

We both got credit reports and Experian confirmedthat neither of us have ever had anything like this, in fact we both have goodcredit. We have tried to contact thelender but they don’t speak to members of the public, they only speak tomortgage brokers. Our broker has appealed the decision and has contacted them,this was over a week ago, he has left messages, emails and they are not gettingback to him.
My husband called them today and couldn’t getanything out of them. He has now written them a stern email asking them tocontact our mortgage broker….it’s exasperating!!

The CCJ will cleearly show to whom it is registered - there is no such thing as an address black list if you like - its individual specific, so if you have been declined on this basis, it is registered against one of you/non-disclosure.
So if you are adamant that you left no unpaid accounts at that address (mobile phone, gas, etc), advised all financial/utility providers of your new address, and had a redirect mail order in place, this leans towards a fradulent financial application in your name, or another error.
You need to do a multi agency CRA check (equifax, experian, call credit), to see exactly whom made the registration, what its for etc, you can then set about sorting the issue out - either by satisfying if it is a forgotten account, or having the matter investigated and a file marker placed, if it genuinely isn't an account you held/applied for.
Checkmyfile - http://www.checkmyfile.com/ - will search all 3 CRAs, so you can see whats going on (and if there are any other unknown accounts lurking - they have 30day free trial and its easy to cancel if you don't wish to proceed.
Alternatively you can contact all 3 CRAs directly for a copy of your report (small fee).

Ok you have an experian report which is blank, if the lender uses them as their CRA then there's an issue at their end - however as noted above, your lender may use Equifax or Callcredit for the status checks, and where the info may have been recorded (although CCJ should come up on the public domain check with all 3 TBH).

Holly, thanks for the info. Both hubs and I lived at home with parents before we bought our current property (where we now live) so had no bills ect...It's definetely not ours everything has been checked.0 -

When I was placing, I think I recall them using Equifax. (as I'm not currently on the front line to verify current CRA source, sure SPM will confirm if thats still the case, with they now forming part of LLoyds BG).
Could of course be a human error/crossing of info between cases at UW ..... get your 3 files together and then you'll know a bit more on whether its a BM processing glitch
