CCJ and equity transfer

Ive posted a couple threads on here and most of the replies have made sense so thank you. Ive spoken to the solicitors dealing with the case and they have told me that a CCJ has been applied for. Obviously im not happy but at the same time I understand that the bank want their backmoney. The siutation as it stands at present is as follows.
Transfer of equity applied for April 2013
All relavant form's filled in and sent back to solicitors including TR1
and declaration of solvency
Mortgage Company have acknowledged the TR1 and have sent it back to the solicitors stamped.
The part above is the less messy bit. The next part is the sticky part.
Debt of £28000 owed to RBS
Default registered in 2009
Court letter dated 2nd October with action of CCJ.
Now. The transfer is between 3 people. Myself, my brother and his partner. They are taking on responsibility for the mortgage. My worry is that:
Will the transfer go through as it is at the final stage?
What impact will the CCJ have on my brother if any, especially as I had the declaration of solvency signed by a solicitor, and this was prior to me knowing about the CCJ.
I really hope this makes sense and someone can answer my point's. I am concerned for my brother and id like to understand that hopefully this will not impact on him
Thanks
Paul

Hi there, it does seem like a complex situation, but I will try and help. I used to work in Mortgage securities & dealt with transfers of equity all the time.
Could you let me know who the CCJ is in favour of? Is it RBS? Who is the solicitor acting for? You and RBS or just you? Do your brother & partner have a different solicitor?
Sorry for the questions, but this things can be very complex0
