Very interesting! Just looked back at what I signed back when I last moved - they bang on about credit checks and all the rest of it, but in the bullet point list it only says "any adverse credit history such as, bankruptcy, CCJs and court decrees" - so public information but trying to scare away tenants that have missed payments/defaulted on bank accounts/cards etc!
So if they don't take it to court and get a CCJ, it wouldn't show. Interesting. Can't see them not going for court though, but we'll see!0 -

Court action is relatively rare if you are making payments on consumer credit debts at a rate you can afford. It does certainly happen but its usually a last resort for a creditor either if the debtor is paying nothing, or if they have good reason to think that the debtor can afford to pay more or they think the debtor has substantial assets.
(Obviously don't know your current situation or if you are making payments to the debts).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Not making payments, they threatened me with court last time they showed up, and ignored my offer of payment because I won't give them my new phone number.
Haven't got any assets, which they know, so just wait and see if they want to pay to take it to court now then I guess. My thinking that they would was because it will certainly do them no good (cost them more and still get next to nothing), but it would be done to inconvenience me....0 -
Hopefully you made the offer in writing and have some proof of sending it. As Valhaller says, if not, do it now.
Also send them a written complaint about not accepting a payment offer as you refused to give them a phone number. No where in any of my credit agreements does it state that a phone number is required.
If you can show a judge that your creditor is not being reasonable, it won't go down well if they do try court.
What bank is it, or is it now with a DCA?:beer:0
