Amount owed issue

Im wondering if anyone can help.

I have been paying back a debt through Anderson Strathern for a loan I got in difficulty with from the royal bank of Scotland. I have been paying it back regularly for quite some time now (2008 ish). During that time I had no statements at all from either AS of RBS. A couple of years ago I managed to claim back PPI from RBS and because the PPI went straight to my debt I decided it was time to check my statements and requested them from both AS and RBS.

The original loan was for £16k in 2004. In may 2012 my statement said I ws due £11545. I had regularly been paying £150 a month. Then I got my PPI back and the RBS statement said my balance was £4546 in August 2012. So I was beginning to see light at the end of the tunnel.

Then AS sent me a statement August 2013 and they said I was due a whopping £19,811.71!!!! I nearly fainted. Almost the same week I got a statement from RBS saying I was down to just £2909.17. To say I was confused was an understatement. I contacted the RBS but they just said they couldn't discuss and to contact AS. Eventually I got them to listen and they said they would check it out. Next day AS sends a statement saying oops very sorry the solicitor fees are waived so you are only due £8661.09. Then on 3rd October another statement saying I'm due £5916. Still not in line with RBS statement, but less heart stopping.

To top it all off I had yet another statement from RBS saying balance is £0 and account closed. What on earth is going on! AS insist that they have the correct total as they know what interest I should be paying etc. clearly they don't. Any advice on this one would be appreciated. I am currently still paying, although they did try to up my monthly payment but I stuck it out.

  • They should be sending you annual statements.

    I would stop paying for now, that will get their attention.

    Then write a complaint to them, asking !!!!!! is going on and that you require statements of account as you should have been sent annually.
    Also enclose a copy of all the contradicting amounts.

    Refer to FOS after 8 weeks if no joy.

    If the loan was taken out before April 2007, hit them with a CCA request. Missing or not correct in every way means no CCJ for debt before that date.

  • RBS do send annual statements but AS just send a letter stating what is owed, what the interest charges are but no breakdown, unlike RBS.

    Sorry for my ignorance but what is CCA request? And the second I stop paying they hit me with wages arrestment. Was threatened with that before. The original loan was taken in 2004.
  • CCA request=copy of the agreement you signed.

    So this went to court and you got a CCJ for this?

    I would still complain, in writing, including a copy of all contradicting info.

  • No it hasn't ever been to court and no CCJ
  • They can only take money from your wages if they have a court order and you don't pay. They can then go to court to request this. As far as I know.

    If from 2004' then send them a letter, signed for, requesting a copy of the agreement for the account as entitled under the consumer credit act. Include a cheque or postal order for £1. They have 14 days to respond or the account becomes unenforceable in court til they provide it. Post back here when they respond, as they are known to send you junk or just lie.

  • Thanks for that. I will give that a go. Fed up of getting such varying amount in my statements. It's been a long road but this will be my last debt to clear then I'm done!
  • Much easier to deal with these people if your account is unenforceable.

  • Had an acknowledgement from AS today, says they have referred my request to their client for the CCA and they will contact me directly.

    I've also been to see CAB and they are going to look through all my statements and contact them regarding variations. They seem to think I have probably paid my debt back already considering how much I've paid ove the years so fingers crossed.
