Recovery action letter from Fenton cooper

Hi

For the past two years my partner has been chased by a company called rockwell for a debt of £2000. This was original chased by a company called arrow global.

My parter has disputed the debt as statute barred but having this fell on deaf ears she has not communicated with Rockwell at all for the past 12 months.

She has received the usual threatening letters with baliffs/court action etc but nothing materialised.

Fenton cooper ( who I believe are the same company as Rockwell) are now stating that as she has failed to resolve the matter satisfactorily with Rockwell they are now escalating the matter.

Are Fenton cooper a toothless tiger or can they send a debt collector to the the door? She is not worried about court action as she has a case. What are the chances Fenton cooper will go down this route and what will the procedure be?

Many thanks

  • How olds the debt?

If not paid or acknowledged in writing for 6 years then its statute barred. The only defence required in court.

They use words like 'escalate' 'may' cos they will probably do nothing and these words are generic and meaningless.

Debt collectors at the door have no rights. They are toothless tigers without a court order.
You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'
