Aktiv Kapital statute barred debt

Hi,
I recently sent this letter to Aktiv Kapital as they have been asking me to pay a loan from 7 years back.

Dear Sir/Madam

Firstly, I do not acknowledge the existence of any debt in the above stated by you. . You have contacted me regarding the account with the above reference number, which you claim is owed by me.

Secondly, I would point out that under the Limitation Act 1980 Section 5 that the alleged debt is Statute Barred.

The OFT under the Debt Collection Guidance on statute barred debt state that ‘it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period.’

Unless you can provide evidence of payment, written acknowledgment of any outstanding debt in the last 6 years and a copy of the signed credit agreement, I should be so grateful if no further contact is made.

Should you continue to harass me regarding this alleged debt without providing the documentation required then a complaint will be made to the Financial Services Ombudsman without further notice.
In addition, this letter will be brought to the attention of the court if any proceedings are issued in respect of the above.

I look forward to your reply.

Yours faithfully.[/B]

Got a reply today saying they investigated the issue I raised in my letter and they can confirm that legal action on my account would be statute barred under limitations period. They then said, they have taken the decision not to pursue the matter any further and can confirm that the account is now closed and that I would receive no further contact from them regarding this matter.

Now not sure if that is still going to affect my credit rating or does that mean it gets wiped off my rating???
What is the next step for me please?

It will be removed from your credit report 6 years after the default date whenever that was. May have come off already, or the default date may have a short time left.

Very surprised that Aktiv Kapital even responded to your statute barred letter ophelia20. Normally in these cases, you don't hear from them ever again. Keep their response in a safe place.
You may question anything I say. Just be polite, otherwise you go straight on to my Ignore List, which funds a good old fashioned knees-up every Xmas. Cheers;)
