BR and being chased by NRAM

Dear All

I know I have asked this before but any help will be much appreciate it again.

Both myself and my wife declared BR in August as I lost my job and could not afford the mortgage as property was in negative equity we could not sell.

I sent the keys back to NRAM with a letter stating that we would like to hand the key back and voluntary surrender the house. I was told by friends and kind people on this forum to not to sign any forms which NRAM might send me as if I sign I might be liable for any shortfalls.

NRAM have been phoning me on a daily basis saying that for voluntary surrender to go ahead I must sign the form. I returned the forms back to them and crossed out he line which sated that I might be liable for the shortfalls, and they said they can not accept this. The advisor from NRAM said that she reassures me I will not be liable as any shortfalls will automatically be included in the BR but hey are not selling to write to me to confirm this and said that this is the only form they have and I have to sign it.

I am not sure what to do and any help will be much appreciate it.

Thanks

Let them get on with it.Ignore, ignore and ignore. They are toothless lions. Don't talk to them, if they ring put the phone down. If they write to you just file the letters. They will eventually go to court and repo. The more you engage them the longer they will take.

You do know you are responsible for the council tax until it is repo'd don't you?

Thanks for this. I have not signed anything, so they assuring me I am not liable is just a lire I suppose, I cant believe they can do this.

I know about the council tax and Lewisham have given me exemption until November and am hoping they can extend this until this gets resolved as I can not afford to pay two council taxes.

    Hi All

I just received a letter from NRAM saying as we have declared bankrupt we will not be liable for any possible shortfalls as a result of the sale of the house. They saying that I should njow sign the form for the voluntary surrender which has a line in there saying I might be liable for any shortfalls.

Either ignore them or tell them that you require a form to sign which states that you won't be liable for any shortfall.

Actually I would send them a final letter (LBI- Letter Before Inaction?) telling them you are not signing any form and they can repossess if they wish or leave the property empty.

  • They are Bankers and personally wouldn't trust them one little bit, there is no need to sign for them to VR so IMHO wouldn't sign anything, change your phone number and let them go on their way.

  • I can concur at the'ignore' method. Nram tried all sorts of insidious methods to try and persuade me to sign a 'deed of acknowledgement'. I unplugged my phone, got family and friends to ring our mobiles only.

9 months later I received a letter from Nram saying they have applied to the courts for a repo order.

  • Hi I'm amazed they are still chasing you! I had a mtg with nram, one of the 125% ones. I went bankrupt in 2012 and sent keys back to them. They changed locks and I didn't hear a thing until they sold it a year later as solicitors needed me to sign a form for completion to go thru. Think they r trying it on with you. Do not sign any forms!!!
