Help with a possible CCJ pls

Hi All,

I wonder if you lovely lot could help with a problem to do with an impendiing ccj?
My sister has an old cc debt with hsbc and has stupidly just buried her head in the sand with regards to setting up a payment plan etc.
Fast forward a few years and they have finally sent her a claim form chasing the debt (£2.5k).
Now she's finally realised that she wants to get this sorted but cannot afford to pay all at once and can only pay say maybe £20 per month.
So my question is, is it too late to reach an agreement with hsbc before it gets to her getting a ccj? Also how does she fill in the claim form to that effect?

    Don't think there is any formal way to request that on the claim forms? You either admit or defend the claim?

    She may be able to get a agreement from them to suspend the court action if she talks to them direct, but I would be wary of trusting any such agreement unless obtained in writing. HSBC are sneaky and may well just apply for judgement anyway.

    I can't see HSBC withdrawing the court action to be honest. If the court agrees that the sum is owed then a CCJ will be granted (unless she then pays within 28 days). She can also write to the court when the hearing is due to take place to ask to pay in installments and enclosing her budget sheet to show a reasonable payment plan. If the order is still made to pay forthwith then she can apply to vary the order (ie pay in installments).

    A ccj isn't going to make her credit file much worse though. It sounds like its already defaulted. If you can get them to agree a payment plan (in writing ) without having to go to court then that would obviously be the best but don't hold your breath.
