Parking out of marked bay

Hi there

I have just picked up a ticket for parking out of a marked bay in a free parking area when I had parked between two cars as it was getting dark.

When I got back to the car at least one of them was still there I did not notice the ticket till I got home.

Its in England and was going to follow some good advice here when I saw that if it was a company car then things are handled slightly different

How is handled differently if it is a company car

    It was in a retail complex car park where it is free parking as we were going bowling
  • Do some reading on the forum, do a search for 'company car' - it seems hectic with bits of information all over the place but stay calm and don't panic - read only RECENT threads (past 2 months or so, as they contain relevant up to date information).

    I take it was a ticket attached to the windscreen? You will have to wait for your Notice to Keeper to pop through the door before doing anything (this will be minimum 28 days from the issue date) with UKCPS. If they don't send the NtK in time or it is worded incorretcly this is virtually a guaranteed win at POPLA. Don't contact UKCPS before then - take some time to do some reading, get your appeals in order and post them on here, when the NtK arrives post on here with as much details as possible.

    DO immediately contact the retail park landowners and demand that they cancel the ticket (do a web search to find out who they are - name and shame publicly too). Were you at the bowling alley? Complain and demand that they cancel the ticket too - how dare they allow a paying customer to be subjected to this sort of carry on. Don't send wishy washy emails and wait a week, if you can, go face to face, speak to the manager (not customer service or a receptionist) and don't let them fob you off. Ask them to cancel it there and then - much success has been had with this method.

    Free parking? All day etc? May not be relevant but I'd get back there sharpish and get some pictures of the signs, they are normally illegally worded and all this helps the cause.

    OK - jeanraffio gives the usual advice but I say that 99% of the time you CANNOT WAIT for the Notice to Keeper when it's a company car. Unless this car's registered keeper is a small company where they OWN their own cars (not leased) and where you are CERTAIN they will let you handle the appeal and not just pay it. The problem being, of course, is that you are not the registered keeper.

    If it's a large company that owns the car then don't trust them; they or the lease firm will likely just pay it if they get a sniff of this fake parking ticket.

    So don't let them get a sniff at it!

    Appeal EARLIER than our normal advice. Appeal now. See other UKCPS threads for what to say in any appeal to them but obviously you can't call yourself 'the registered keeper'. So call yourself 'the keeper'. DO NOT say it's a company car of course and you don't have to actually say who was driving, you could say 'we visited the bowling alley and we have now complained to the Manager...'.

    To find other current UKCPS cases from here and from pepipoo (which WILL help you understand the games UKCPS play and be ready for their replies) Google these words:

    'UKCPS address the factual issues'

    Happy reading (look at any cases from here and from pepipoo) and then draft a challenge to send them immediately - show us first if you wish. But beware because UKCPS staff read this forum and for that reason, do NOT reply to pm's about this at all.

    You can beat this at POPLA stage - a stronger appeal, which you'll read about on the other UKCPS threads once you've done that simple Google search.

    Oh, and DO COMPLAIN IF YOU WERE SPENDING MONEY SOMEWHERE, COMPLAIN TO THE BOWLING CENTRE MANAGER!!!!

  • Thanks guys. I have already sent an email to the land owners I will get in touch with the bowling centre.

    Though it is a company care I know the main contacts and can talk to them so I handle all the appeals as we are down as the registered keeper even though its leased.

    So it would be ok for me to wait until the notice comes through

    If Leased, it is another set of rules - the leasing co will have stipulated how they handle and charge for this - and it is rarely (if ever) free of cost.

    The lease will stipulate whether they pay and re bill you, or refer your details and charge a fee.

    It looks as though you may be paying something if not all of it regardless of your wishes.

    No. Please don't. jeanraffio's advice above was not quite right where it concerns company/lease cars. Are you absolutely sure it's your company on the V5 document, i.e. what the DVLA have. That would be unusual for a lease car. Even if you are buddies with the fleet operator in your company, the lease company who is probably on the V5 play by their own rules, often in contravention of the lease agreement itself, i.e. they pay these non-fines and pass it on (plus au unjustifiable, profiteering admin fee) to the leasee.

    In this case, as well as contacting the landowner, you really should appeal direct to the PPC. Do so not as the driver, but as the "keeper" at the time of the event. Say "I was keeper ...", and then go on to say "The driver did this, that and the other", whether or not they were the same person.

    Be sure to give your name and address (as keeper). You MUST prevent the PPC going to the lease company, which they know is an easy touch. Do not mention that it is a company/lease car.

    I think it would be the lease co that would get the silly Notice to Keeper and that's where the danger lies. Lease co's pay these sometimes - but you could clarify with the Fleet Manager at your company and put it in writing that if they or the Fleet co get the Notice about this 'incident' you will appeal it and take full responsibility. But would the Lease co adhere to that? What does the car contract you have say?

    If you are in any doubt then send the appeal now to hook the PPC in your direction. Similar threads running here:

    So be warned and appeal if unsure about your position right now. The last thing you want is for this to be paid without yur say-so and then you would be told to pay, leading to a company grievance on your part, etc. which isn't worth the hassle.
