Hi there im brand new today but sa this and thought I waould reply.
With regards to the attachment of earnings they cannot deduct from your wages until they have a county court judgment. You would then have to be in default of any order made before they can even apply for an attachment. (ps this is my job - dont hate me!)
By paying £100 off a £750 balance you would have probably cleared the balance before it got this far!
Also in my experience a debt collecting agency would probably accept this amount anyway without ever having to visit your home. When I got into financial difficulties a few of my creditors wouldnt accept my offer. When it got transferred to debt collectors they quite happily accepted ny original offer and they are now paid by direct debit.

I see now what the problem is with the account. usually under the t+c's you have to pay in a minimum amount to the account each month. If you have been paying £30 then they have got a bit jittery that you are going to make like a small invertebrate and Bug*** off!! esp if also not making transactions on the acc. (makes me mad!!)
No the form is just asking for what you earn which frankly is no business of theirs. An attachment of earnings means they get your employer to deduct it from your wage before you are paid. this can't be done without going through a whole long procedure first.
Send them an equivalent of your SOA, see cccs website for assistance with this detailing absolutely everything that you have coming in and going out including birthdays christmas haircuts dentists vehicle maintenance. You know the kind of thing.
They do not need to know who your mortgage is with or how much your house is worth
They do not need to know how much you get paid per year or who your employer is.
If they reject this then it will go to a debt collector who are much easier to consult with as they actually take a realisitic view on life!!

Hiya Penguin 83, Bless, No I Dont Hate You Lol. So What I Need To Do Is Fill In The Forms They Sent Along With An Offer Of 100 A Month, And Wait To See If They Accept This. Why Are They Threatening Solicitors And Dca`s Then? Also They Say I Ignored Previous Letter. When Actually I Wrote And Told Them I Would Be Paying 100 A Month And They Returned A Mangaed Loan Form To Sign? They Really Are Horrible And The Chap I Spoke To A Long Time Ago Re A Different Reason Was Really Pompous And You Swear It Was Him I Owed Money To. Bottom Line Is Credit Card Balance £49, Account £750 Overdrawn (750 Limit) Hardly Criminal Is It. Also Have Sent First Letter For Bank Charges So Perhaps Thats Crawled Up Their A**e And Offended Them. Thanks Again. Will Send Form Back With Proposal And Keep All Correspondance As Security If They Wont Accept It And Demand It In 7 Days Like They Have Said Is As Long As Ive Got, And While Im Fishing 750 Out Of Fresh Air I Will Grab Next Weeks Lotto Numbers Too And Post Them On This ThreadDFW NERD....560

Hi Pania, Mind You If Debt Collector Comes To House It Wont Be Hsbc I Be Worried About It Will Be My Husband!! He Thinks Everything Is Hunky Dory. I Know I Should Tell Him (other Debts Too) But Dont Think I Can Face The Blast. I Work Damn Hard As Well As Bring Two Little Boys Up. I Have To Work Nights As I Cant Afford Childcare. Hubby Has Been Forced To Go Self Employed As His Company He Was Working For Went Insolvent 10 Days Before Christmas 2006, And We Dont Know Each Week How Much We Have Coming In!! We Have A Small Mortgage And Quite A Bit Of Equity But Whos Going To Give Us A Remortgage When Hubby Is Selfemployed And My Credit Rating Is Poor. Think I Will Have That Cuppa. Just Read Your Last Thread Pania. Yea I Got To Look On Bright Side And Make Jokes Cos Other Side Of Coin Is Depression And That Wont Help Anybody. I Will Sit Down And Put My Soa On This Week And Other Folk Can See That Their Probs Are Not As Bad Aas What They Thought, They Prob Have Parteners To Share It With But I Have Kept So Much From Oh Partly Due To Him Being A Terrible Worrier And Its Not Worth Having Two Worriers And Part Because He Hasnt Got A Bloddy Clue About How Much Things Cost These Days!!! sweetie please be a bit fairer to yourself. You are doing fantastically well just acheiving what you have done already. two little boys must be exhausting, and working nights also. It sounds asthough your batteries are worn down. DH won't be able to curb the spending and assist you if he doesn't know whats going on. There are many people on here that have been terrified of telling their other halves the truth and they have been so supportive but only you know if this would be the case with yours. yes you'd get the rage, then the disappointment, but eventually the acceptance. You are NOT to blame for this situation, sometimes just trying to make ends meet means we borrow money, then borrow more and so on. What we need to do now is get you towards getting out of it.
Re the remortgage.. Lots of companies!! interest rate may be a bit higher than normal but if the mortgage is a problem then you may be suprised.
Debt collection agencies don't visit people anymore unless you've not responded to their letters or told them to poke it up the proverbial. They conduct majority of their business through post and telephone. If HSBC don't accept the offer you make then keep going with it.
Is there anymore debt lurking in the background?
