Afternoon all,
Does anyone know what requirements have to be met in to enable the CSA to apply for a LO ?
I am aware that ;
1-the assessment has to be complete
2-a schedule requesting payment from NRP must be sent
3- the NRP has to be given a certain amount of time to meet the timescales for payment
4- anything else ?????
Also, will the CSA apply for a Liability Order if the self employed NRP states his earnings have recently dropped to nil ? If he states he has no income can they still go ahead with LO ?
Last question- if a LO is granted and a charge subsequently placed on house is interest added to charge as years go by?

i think the csa tried to have an L.O. on us once, they got nothing because we have nothing, it was soon dropped0

Yes - the NRP hasn't paid any or all of his maintenance liability.

Yes and Yes.
If the NRP says that his earnings have changed, that's a matter which is dealt with by considering the making of a fresh assessment, with the PWC being notified and consulted as to what the NRP has said (after all, a report that income has fallen may or or may not be an honest report).
Either way, existing the debt needs to be regularised by being registered with the courts. Only that will eventually enable the CSA to take other, robust, enforcement measures.Last question- if a LO is granted and a charge subsequently placed on house is interest added to charge as years go by?

I don't think so. But that may change with forthcoming legal changes in CS3.0
