hi,hope some one can help
my daughter left her job back in june she has received a letter saying she owes 12.81 x £6.19 for overtaken holiday pay
she worked 2 days a week at two 4 hr shifts
£4.98 hr before she turned 21
£6.19 hr on her 21st and after
her last holiday was the week of the 12th so her 21st birthday was half way through her last holiday week
so one day at £4.98 and the other day of that same wk £6.19
I just rang them to say they had calculated it wrong as they have worked it out as all the over taken holidays at the rate of £6.19 =£79.29 even though all her holiday were taken at the rate of £4.98 except for one 4 hr shift at the rate of £6.19 they said as a good will gesture they will re-calculate it only if it is over a certain amount, if it falls under a certain about she will have to pay all her overtaken holiday pay at the rate of £6.19 surely that can't be right

Your daughter needs to write to them herself, with a breakdown of her own calculations. Dates taken before her rate changed, and dates taken after, with a per day breakdown of the rates.
Don't bother phoning them, just put it in writing, and make the appropriate offer to them with her figures. She must do the letter herself, as they should not be discussing it with you anyway under data protection rules.

Did she work only the hours contracted or did she do regular overtime? This may affect the holiday rate of pay.
Also, a letter sent recorded is far more proof than a phone call.0 -
Tell your daughter to make payment for the actual amount she was overpaid. Tell her to tell her employer if they want anymore to take her to court for it.0

They may but if it's sent recorded delivery then you have proof that they have received it.
I would echo what others have said though, this should be done by your daughter - I don't know of any managers who would deal with an ex-employee's mother, unless the ex-employee was incapacitated rather than just a bit busy.0 -
whether I rang or my daughter rang that's not the issue,the issue is the questions I wrote at the top ,the head office don't have a problem with it so it doesn't matter0
