debt after 6 years

hi , I got myself into debt back in aug 2007 , I signed up to a company called debt free me uk and they took care of all my debts for the sum of £21 per month , they advised me that I would be credit/debt free in 5 yrs , this did not happen , I kept up the payments religiously never missed one. as I was in such a terrible place (health wise) 6 yrs ago I jumped at the offer of help from a company which I thought was there to help.
possibly a year ago they changed their name to moneyplus group.
two months ago I received a phone call telling me that they can no longer help me as they have to put their charges up at least £60 per month and the law had changed , this I still cannot afford.
so after 6 yrs I am now back to square one , I have been to the CAB and they are helping me to try and sort it but I would very much appreciate some more advice.
I have already had one phone call telling that I have missed a payment and if I miss anymore the bailiffs will be calling.
can I get a debt relief order or an iva or bankruptcy?
CAB have told me to call all my creditors and set up a direct debit with them for what I am paying now , is this right? , I do not have any contact details for some of them so how do I do this.
I did ask moneyplus group for all of my documentation and they sent me 1 piece of paper with my original balance on it and list of creditors no contact details or statements of what I have been paying over the years , not a lot of help.
where do I stand after 6 yrs?
what's the best course of action?
my point is this I was missed sold this payment schedule (like ppi) as I was told about being debt/credit free after 5 yrs ?
moneyplus group say that I wasn't on any sort of plan or iva so what was paying for? I could have kept paying for the rest of my life not knowing any difference.
CAB have checked and I am not on an iva

don't want to go back to that dark place again.....................regards

    Ignore the CAB.
You will need to see if any payments were made by this shark set up to any of your creditors.
They might have just pocketed what you were paying them.
You will need a set of template letters for each company that contacts you.

Well, once a creditor writes to you asking where the payment is, write explaining what happened and ask for a statement of account. They are obliged to send you this.

Maybe call stepchange once you know the status of your accounts.

Also get a copy of your credit report, it will show account status, owner and current balance. Unless 6 years after default in which case the account should have gone from your file.

    Good luck

I would do a subject access request to debt free me.

You need to know what and when they paid creditors, and also what letters they sent on your behalf to your creditors as your appointed agent.

A formal SAR (for which you need to pay £10) will mean they have to provide this information to you.

Were bailiffs specifically mentioned on the phone? do you know if any creditor has obtained a CCJ against you (You would have had letters in the post).

spacey2012 yes they have been making payments but only £1 per month the rest was taken as admin charges. what do you mean by template letters and where do I find them?
I know you said ignore the CAB but I need some sort of support as I got myself in such a bad way 6yrs ago , what makes you say that spacey ?

thanks happy_bunny I will do that once I get my account details, thanks.

thanks to everyone for this advice

What is your financial situation currently?
did CAB go through a monthly budget with you to see how much you could afford to your debts a month?

If not maybe have a look at the step change online debt remedy tool.

hi tixy , yes CAB have done a financial statement and I am £-321 per month worse off , I just cant cope with this again , am really struggling to pay anything and I work full time , I do not have a phone, sky or any sort of luxury item , a crappy old banger to get me to work , I do not even have a flat screen tele , I don't have holidays , I just seem to be treading water and living day by day , borrowing from peter to pay Paul.
with that sort of defecit how can I possibly afford to pay anything?
do not qualify for a dro , or an iva is bankcruptcy the only choice?

    thanks for your help

I'd think bankruptcy is certainly an option to explore if you cannot afford anything to your debts and don't expect your circumstances to change anytme soon.

Think you need to head over to the bankruptcy board.
