Employer late with wages

Hi,
My employer has failed to pay me on the designated date (end of each month). It's now a week late and rent/bills are already coming off. I've been communicating regularly with my employer about the situation, but I keep getting excuses. First excuse was his business address was rejecting mail, which led to his bank seizing his overdraft. He then offered to pay me via PayPal (Which he has done in the past a few times) I agreed to this as it ends up in to my bank straight away anyway. He then stated that PayPal had a spending limit and so that was not going work.

He has delayed paying me in the past a few times, but this was normally sorted a couple days after. I'm his only employee, I have received my payslip which states how much I am due to be paid and how much tax/NI.

What can I do about this situation? I've spoken to CAB and they didn't really give much information except to wait 2 weeks before going back... I'm consistently messaging my employer and only get a couple replies a day with excuses.

It's my first job since I graduated from University so I took it with open arms, been working here for 7 months now and apart from a few times where he paid me late it has been fine.

Thanks

    A few times late already?

    Why so?

No excuse at all and you are being fobbed off

Breach of contract if the contact states a pay date

Well the contract states that I will be paid monthly in arrears and verbally agreed on the last working day of the month.
  • If you go overdrawn I bet your employer doesn't pay the charges.

This is really bad form from your employer.

You should ask him to pay you a month in advance.

Is there any way you can move the date for the DDs back to give you a bit more leeway? I agree that this doesn't sound as though the business is doing brilliantly.

Fortunately a family member was able to help me out with the rent.

It is real estate and I'm the software programmer. It most likely is down to my employer's financial problems. What sort of rights do I have here?

You have the right to be paid on time as per the contract on the right date. Would be a shame if the software went a bit wrong eh

Rights can be a bit academic if there is no money.
