    I would have CCA`d them, most likely have to pay nothing at all, but if your happy to settle for that then well done.

  • We did CCA them and they don't have the paperwork, but as they still have quite a lot of power to bug us and can demand the money when they do finally find it, we preferred to get it sorted for good.

    That is useful info and I think it shows the value of going down the cca route (when applicable) prior to F&F negotiations.
  • Thanks. I wanted to update a) because of the help I got here and b) because it was so frustrating trying to find anecdotes from other people about what they'd settled for!

    The letter DLC sent back after the CCA request quoted the McGuffick (?) case and looking through that it seemed to say that whilst they might not be able to take us to court they were still able to do everything up to that point- letters, phone calls, veiled threats etc- as well as continuing to impact on my credit rating. It didn't seem worth going through that level of hassle just to avoid paying anything, especially as if they did find the paperwork we'd be back to square 1. I felt it was better just to get rid of the whole thing as cheaply as possible.
  • I'll put a little explanation about the phone call, because that would have been handy for me to know and might help someone else in the future.

    My husband made the call- he stayed very calm throughout. Initially they offered to take 25% off, then 50% and the person who took the call said they'd have to speak to their manager before they could offer more. My husband held and they came back with the acceptable offer.

    During the call he politely refused to
    - give a ballpark figure he was prepared to accept (we'd actually have gone up to £100).
    - tell them if he had a mortgage or any HP, pointing out they would need to go to court for that information.
    - give any other financial information other than the fact that he's disabled and so we're on benefits.

    In short, he made them do the running and didn't let anyone else have control of the negotiation.

    When a company cant be bothered with your debt they sell it for cheap, eg £30 for £300 debt. then the other company chases you for £300, Why dont origanal company offer to settle for £30 to you in the first place???? very immoral these company's.
  • I thought it was pretty stupid, given that we were making regular payments which would have paid everything off next year and had also offered them £200 earlier this year. But hey, it worked out for us!
