DCA asking for a payment for proof of debt

Hi,
I had a letter from Credit Solutions Ltd. saying that they are handling a debt from an expired bank account of mine.
As I had not had any information from the bank regarding any alleged outstanding debt nor been informed that a DCA was getting involved, I wrote requesting the notice of assignment and for a copy of the original, signed credit agreement.
They have replied demanding a fee of £10 under the Data Protection (Subject Access) (Fees and miscellaneous provisions) Regulations 2000. I want to know if they are allowed to do this or if they are simply trying to get money out of me.
I hope someone can help.
Thanks,
C

No you don't need to pay, and shouldn't, because you haven't done a subject access request.
For a CCA request (for a copy of the credit agreement) they can charge a £1 fee.
However all you need at this stage is proof of the alleged debt - the template prove it letter should provide you with this - Letter when you know nothing about about the debt - AKA "Prove it" letterA smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Sounds like someone at there end not too clued up on procedures, write back with the "prove it letter" as advised.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hi,
Many thanks for your swift replies :-) I have drafted a reply with the 'prove it' details again so we'll see where that goes...
Sounds a lot like they are trying to scare me into just paying.

Or just trying it on.
Agree with the above. Under OFT guidelines they are obliged to provide proof of a reasonably queried or disputed debt, WITHOUT making a charge.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
