Just had a bailiff come to my door

Hello,

Firstly thanks for anyone taking the time to read this and offer any advice.

Yesterday, a bailiff from Marston turned up at my door and handed a letter to my uncle, addressed to me.

My uncle told them that I was not in.

The letter is a removal notice, stating that they want 633.30 or they will come to my address and remove my goods. It also says that they do not need to warn me again to come and seize goods. It is my parents house and I am worried.

The debt is for an unpaid magistrates court fine for an unpaid train fare (Yes, I am a complete idiot).

I have no idea what to do about this.

The house belongs to my parents and I live here with my brother, mum and dad.

My parents are on holiday at the moment and will return on Saturday.

I can't get to the citizens advice bureau until Monday.

Are they allowed to come in and take the things that do not belong to me?

All I own is a computer and a TV.

I'm very very scared right now and don't know what to do.

If anyone could guide me in the general direction of the best course of action, I will highly appreciate it.

    1) I apologise for stating the obvious, but first of all, learn from your mistakes. There are so many lessons here for you to learn that to start quoting them would take pages.

    2) You will have to pay the fine. Court fines are serious. There is no way out of this. Whether or not the bailiffs are allowed to take your parents things is not really a question in the big scheme of things.

    3) Through the court process, you should have been given information on paying your fine, on what to do if you do not have the money, including paying in instalments.

Contact the magistrates clerk immediately and tell them that you do not have the money, and would like to arrange paying in instalments. I'm not completely sure whether you can actually do this at this late stage, but I'm assuming you can. While you're paying the fine in whatever instalments you can afford, it will keep the bailiffs away. They will probably make you complete a means statement to show your income/expenditure and choose an amount that you can afford.

Welcome to the adult world. Where doing whatever you want will result in severe reactions.
  • Are they allowed to come in and take the things that do not belong to me?

No they're not, but it will be up to you, to prove you don't own the items.

However, this case is far more serious than what they can or cannot take.

Unlike in the case of a normal civil debt, in this case the bailiff can force entry.

Ultimately, you could even be arrested.
