Blackhorse Car Repossession

I'm due in court tomorrow as black horse wish to repossess my (their) car. I made an offer via the court paperwork of £200 per month, which black horse replied saying that they wouldn't be asking for a suspended order as I have already shown I have broken the terms and conditions and would be likely to do so again.

In total, with fees, I owe approx £6600, and am around £800 in arrears. My monthly payment was £167 per month.

How likely is it that the car will be repossessed?

I believe the car is worth considerably less than the £6600, therefore I will still owe after it is repossessed. I wouldn't be able to pay £200 if its repossessed as I would need to fund alternative transport

I know its all my own fault, Im not slating Black Horse whatsoever, just asking what the chances of retaining the car are?

    Maybe they won't even turn up in the hope that you won't either?

    Make sure you go to court!

    Did you make any kind of defence? Did they follow the correct procedure like a proper default notice, did they send a final notice giving you 7 days to pay before terminating and starting court action?

    Perhaps a bit late now but make sure you attend and put your offer before the Judge. From your figures @£200 per month this would pay the arrears off and probably reduce the original term of the loan so say this to the Judge. Do you have a reasonable explanation as to why you fell behind?

    BH spout all kinds of rubbish to make themselves look as though they have the upper air of authority. It's all rubbish because how can they possibly know what will happen in the future? Perhaps they will go bust going by their crystal ball readings eh?

  • Hey thanks for that, that's given me a glimmer of hope!

    I believe BH have followed the correct procedures

    I have no reasonable explanation other than stupidity, as I say all my own fault.

    With the help of this site and excel I've worked out a budget, which means I can afford to live, and repay all my creditors. To be honest I needed something like this to kick me up the backside and make me take a look at myself.

    Keeping the car would make things easier as my wife is a student nurse, and Uni is 50 miles away, and I need a car for work. Having said that if they do take it, it wont be the end of the world, It will just mean it takes longer to repay my commitments

  • This happened to me in Feb, they didn't bother showing up to court and I had to wait over 4 months for a new court date and then I did not receive the papers with the date and the car was repossessed a few months later!

    So say about your wife being a student nurse (poor student, training to be part of a respectable profession) if you have other creditors you might be able to mention this, if they take the car IT WILL be the end of your world as you will not be able to afford another and either you or your wife will suffer.

    It can all depend on how the Judge feels at the time but show respect - address Judge as Sir/Madam and wear a suit so you look 'the part'.

  • I've never been to court before :-( except when I was 18 on jury duty. I'm rather nervous to be truthful! Ah well, there's always tomorrow which is another day!

    Don't be scared :) it's nothing like Crown Court. The worst part is going through the security scanner I think.

    Well sort of, I got what I wanted, I pay the remaining balance over the remaining term and get to keep the car. If I default they get to take the car!

    I'm happy :)
