I am going through a similar thing, I had an MBNA card, they refused to honour the ppi so I claimed back only what I had paid in ppi. Unfortunately I was out of work. To cut a long story short. MBNA sold the debt to cap quest.... I was working abroad for 4 months and forgot to make my payments so they took me to court unknowingly. I have returned to a letter saying I am going back to court so I called them they have told me not to attend the court!!!!!! They said they were going for possession of my house! Can they do this? My debt is £6217 and I'm unemployed at the moment....I'll post this in a new thread.

I'm sure they would love you not to attend the court. Unless the court themselves tells you the hearing is cancelled, then you turn up. End of. No matter what CrapQuest say.

CapQuest are a sneaky bunch of lying ****.

They would need a charging order before they could think about a possession order.

  • I think that's what they are going for as I missed the last court date. Being abroad. I have nothing recent from them other than the claim has been transferred to Bristol county court for enforcement.
Can I call the court and explain? I don't think they will listen.

Please read carefully through all the info in this link ---> Charging orders in the county court

Then if I was you I would give National Debtline a call freephone 0808 808 4000 to talk through with someone exactly what you can do from this point forwards.
