tsb

Hi bit of help needed my hubbys ex had run up a debt with TSB(joint account) but they sold it on to debt collectors have come looking for my husband only an they said that when tsb sold them the debt they never mentioned there was another person to be looking for surely this means TSB have missold the debt to the debt company ?? can anything be done about TSB doing this?

    Both creditors are liable for the whole debt. Its usual that in a case where a couple have split that both creditors are chased separately for the debt.

    What paperwork have the debt collection agents provided? has your husband requested a notice of assignment and proof of the debt?

  • No but he knows hes liable its just that they said they had no other names given to them when they bought the debt from TSB so i have sent them all the info they didnt even know it was for a joint account
    We have had no forms from them just letter to say we have to pay it in full. I do understand its joint debt but surely tsb should have sold them the correct information ?

    I wouldn't have sent them any paperwork.

    He should be requesting from them for proof of the debt, and proof they have a right to collect it (e.g. a notice of assignment).

    Are you certain the debt has been sold, and not that they are acting on behlaf of TSB?

  • they told us they had bought it off tsb but other than that i dont know can i still ask for a notice of consignment

    No, this does not mean that the debt is not owed, and it does not mean that it is not enforceable.

    I'm sorry, but the above post reads as though you may think that somehow you can have the debt written off, which would make no sense at all. If you think that they should be pursuing you too (which seems to be your complaint), then you can always write to them and let them know that this is an option.
