CSA ex not paying

Hi I'm posting on behalf of one of my daughters who is having problems with the CSA- 18 months ago her boyfriend left her to move in with someone else (they have 3 kids) he was assesed by the CSA and payment ordered this was paid ,but 6 months ago he gave up work did not sign on, all the bills were in his new partners name , she increased her work hours from 16 to 40 a week (in a very well paid job).
So now he has no income so does not pay a penny ( he has said he will not work again) but the family income has gone up!!!
The CSA has said that this is perfectly legal and there is nothing they can do!!!
So my daughter is worse off and he is driving a new car (not in his name ) and taking holidays.
How can it be legal to deliberatly reduce your income to avoid paying???

    It can and does happen on both sides with working hours manipulated.. Whether the ex is cutting his nose to spite his face, only time will tell. or when his new 'doormat' realises how being used, sounds best rid..

    What has happened to your daughter has happened and is continuing to happen all the time.

    awful behaviour but sadly there is nothing she can do about it. Could she get him to look after the children in the day times to allow her to work/increase her working hours since he is not working?
  • Thanks I thought this was the case as everyone states unfair but legal!!!!
    The kids are at school they do see their father at weekends and my daughter does not wish to stop them (would cause more problems)
  • This will keep happening until there is a more fair was of doing it ! Sorry ,it wont help your daughter much .I dont know how a man can do this- surely he must have a conscience .CSA have a lot to answer for because they leave it so long to 'chase' nrp's up they are faced with such a big arrears bill they go for 40% of the nrp's wages & who can survive on that?
    Hopefully your daughter is getting as much as she can into her family home as she will be entitled to ctc,wtc if she works I think its 16 hours a week,Ch/ben & free school meals.trips etc She could always ask her ex for contributions towards school uniforms,coats & shoes and hope he does the right thing when he has the children & treats them accordingly.

    She doe's work 16 a week, he doe's not pay a penny towards anything.
    He doe's treat the kids well at the weekends, takes them out for burgers /cinema etc. that in it's self causes problems when they go Mum why can't you treat us !!! (but that's another story!)
    Strange thing is I quite liked him!!!
  • Maybe his partner is telling him what to do to avoid paying the CSA.Some women take over a man's life when they meet them.Some are even jealous of the fact that a man has previous responsibilities.Why go out with a man who has children in that case?They have to come first while they are young. The way the CSA treat nrp's though(even the compliant ones!) it makes you realise why some men do this,sadly.
    The children will realise who was there for them when they get older.
    My ex was like this-didn't even see them -just got on with his own life! .Now they have a relationship with him-they established contact through facebook probably!.(I didn't run him down ,I just got on with bringing them up )They are adults now & I trust he is trying to make it up to them!
  • my ex husband does exactly the same, he works 16 hours (well declares 16) and his partner works 48, her words exactly were, untill the youngest is 18 your ex will work min hours, to make sure u get min money!!!

    Heres hoping they all have guilty consciences when they are old miserable and lonely
  • Does happen, nothing we can do legally, you cannot ( on the 2003 scheme ) include a partners income into any assessment, therefore people who give up working and sign on, or dont sign on, get nil assessments / £5 week assessments.

    It happens both ways mind you, women who leave a man with 3 kids to raise to go off with a rich new bloke isnt as uncommon as you might think.
