This has been put up as a defence regarding an illegal levy!!!!
On 22nd January our bailiff attended the property & reported that two cars were outside the property FXXXXXX and HXXXXXX, he was unable to establish if the cars belonged to the debtor. He reattended on 7th Feb, and admits that the car was not at the premises,(NO - it had been scrapped on 29/01/07) however he made enquires which lead him to believe FXXXXXX (Never had, my OH had got if for £50 for spares) belonged to the debtor, so he took a chance as he had seen the car previously & left the levy notice at the premises detailing the car. Urm no he did not as he would have walked past my car on the drive!) The bailiff has accepted that a mistake has been made and further training will be issued. When JXXX provided you with a breakdown in March she obtained the information from the computer, and obtained a copy of the levy notice from our filing in Hxxxxx, so she would not have been aware of this error. Under the circumstances we will refund the £45.30, please confirm if the money should be refunded to the debtor or the council. Err I paid lets give it to the council!![/I]
