1st Credit

Hi
Have been on a DMP with Payplan for last 6 months, one of my creditors is Citifinancial (cr card & loan). They have been fine about accepting the DMP. However, the cr card side rec wrote to me & told me that they had passed the a/c on to 1st Credit but that the terms conditions of my cr agreement remained unchanged. The same day i recd a letter off 1st Credit telling me that payments must now be paid to them (a/c no. changed) to avoid delays & to phone them (usual rip off 0870 no.)
Instead i sent copies of both letters to Payplan & e-mailed to confirm this, as usual these days Payplan did not respond.
Today i recd another letter from 1st Credit entitled Legal Proceedings: threatning court action, bailiffs etc. Also according to my Justabank a/c the o/standing bal on this a/c is £6303.86 yet on the 1st Credit letter it is £6846.27.
I decided to ring them & got an alternative no. off say no to 0870. Spoke to some right surley scumbag who made the usual demand for pymt in full.Told him i had been paying £18.07pm via Payplan got the usual we have no knowledge of this. Wanted my phone no, work no, employment dets i refused (even though Citifinancial have my work dets). Told him would only deal via letter, e-mail, or mobile. Wanted to know how much i earned, time with employer, marital & housing status. In the end he asked me to get Payplan to contact them.
I have sent a copy of this letter to Payplan & e-mailed my case officer via Justabank but i never seem to get any response.
What should i do next? Surely any court would just tell me to pay the same as the Payplan amount has anyone had any dealings with 1st Credit. I also know that they are members of a regulatory body the Credit Services Association, should i contact them.
If they did start proceedings how long would it take then to get a CCJ. As i do intend to go BR at the end of the yr (i am trying to get the fee together).
Any advice appreciated.

Exactly the correct thing to do. Don't pay anyone directly now you are with Payplan.
Normal tactic to frighten you. They will eventually back down and comply with the OFT guidelines if you show them you won't be pushed around, be intimidated, and know your rights.I decided to ring them & got an alternative no. off say no to 0870. Haven't dealt with them myself but have read plenty. They are the same as the rest of them. Vultures preying on the vulnerable. Don't be vulnerable; stick two fingers up at them!

Even if they were even more stupid than normal and do start proceedings, then let them. They would have to accept the same as the payplan amount, and the CCJ would get wiped out in your BR anyway.

They can't take you to court if you have been making payments - period!!!! Don't let them scare you. As fermi says, it is just talk.
Tell them in future to deal with your Payplan advisor direct.

Not quite correct. But court action would be futile, and creditors know this.

As a DMP isn't legally binding creditors could still take action against you. As Payplan have many years experience and have a great relationship with the creditors this is less likely to happen. However Payplan would continue to support you if any of your creditors applied to the court for a CCJ. Thanks for the advice, just thought i would update you all.
Payplan finally responded to my e-mails last week. They say they have not recd any of my prev e-mails the one they finally responded to was made via the Justabank site. Maybe this will help anyone else trying to contact them.
Anyway my case officer says they contacted 1st Credit on 16th June & have now re-assigned future pymts on the Citifinancial debt to 1st Credit but they made no mention of my question re the differing figures between 1stCredit & Justabank.
Also i have now recd a letter dated 25th June from LCS Solicitors saying they are acting on behalf of 1st Credit again demanding pymt of £6,846.27 within 14 days or they will begin legal proceedings for this amount plus costs & stautory interest.
Has anybody heard of these solicitors. I have again e-mailed Payplan & am sending them a copy of the letter. What should i do in the meantime? The letter also states i should contact 1st Credit again.
I have found out that 1st Credit are members of the Credit Services Assoc, should i complain to them about 1st Credit & could i complain to the Law Society about LCS.
Also has anybody any idea what % a DCA usually pays for a debt could i find out under the Data Protection Act.

My partner and I have about 15 creditors in all and I can honestly say that 1st credit have been the absolute PITS. If you read their website it drivels on about how they negotiate fairly blah blah blah. Not one workd is true.
I am having the same problem as you (though I don;t know whether you are making the "full" monthly payment to them, or like me, trying to make a token one, which is all I have afford.
THey WILL not respond to my letters (apart from standard computerised letters) and are driving me insane.
My next letter to the, is going to be a copy of my compaint about harrassment.
LCS SOLICITORS ARE THEIR IN-HOUSE SOLCTRS. If you look at the very bottom of their letter, it states that.
My debt to them is piddling - in the scheme of things (£2800). I'd be interested to know how much they're pursuing for (by private message if you'd prefer) just to see how bad they are.
We arer having to sell our house for less because of them (everyone else is ok for the time being with a £1 payment). Ultimately, we;ll have to sell in order to clear the debts overall but not so cheaply! BAH!0 -
