John Lewis Holiday Pay - Not paying out former partners

John Lewis - has announced it has under paid its staff since 2006, all current staff have been reimbursed.
I inquired as I am a former partner between the times they have under paid staff, if I am entitled to anything. Really I should be as other friends who work there currently and were there at the same time as myself have been reimbursed.
This is the response I have got,

The Partnership Board have made a decision that those partners who have left the business voluntarily will be not reimbursed for the holiday pay. This was a decision taken by the Partnership Board after considering not only the legal and moral obligations, but also the practical and financial implications of undertaking such an exercise. Balancing these same factors, it concluded that they were simply not in a position to make payments to the many former Partners who would have left the business of their own accord during this period.
I hope this helps explain our approach to the payments of holiday pay supplements. I want to assure you that the Partnership has sought to take the fairest and most responsible response to this issue, while taking into account all the relevant factors.

Did JL pay below National Minimum Wage or below what was agreed in your contract?If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0

tbh they wern't given a straight answar either....
I would think that if you should of got paid it though your entitled to it...so perhaps a court threating letter to start?People don't know what they want until you show them.0 -

No, they made a mistake when calculating holiday pay. If I remember what was said on the Tv, they paid less than the law says they should.
Which, I think, means that if you were legally entitled to it at the time then you should get it whether you are still working for them or not.
I think the "mistake" goes back a lot of years, but they are only paying from when they started electronic records.0
