Ok, so the main and first thing is not to panic. If you haven't yet received a letter telling you how much you should pay and how they've calculated it, then they haven't got that far yet. That means you still have an opportunity to provide them with more evidence to consider before they make the calculation.
To properly advise, we need to get to the bottom of which scheme you're on. CSA3 is the gross income scheme, but the percentage payable for 2 children is 16%. CSA2 you'd pay 20% for 2 children but that would be on net income. You seem to have been told a mix and match of the schemes, but you will either be on one or the other, not a mix of both.
So, some questions. On the letter you received asking for evidence, does it contain a 12 digit reference number beginning with a 32? Does the letter refer to the Child Support Agency (CSA) or the Child Maintenance Service (CMS)? In the bottom left hand corner of the first page of the letter, there is normally a letter reference made up of a mix of letters and numbers, what is it? Were you first contacted about the application before or after 29/07/13?I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.0 -
The csa contacted me yesterday with the calculation and it is half my basic salary and they wont accept an appeal against it I am on csa2 as apparently I disnt meet the criteria for csa 3 which I didn't understand. I was contacted pretty much on the date honeynutloop mentioned. As it is half my salary I cannot afford my mortgage travel to and from work tools for my work that I need and general living expenses. I was told that I can ask for a review in 6 months but by that point I would be in so much debt that I would more than likely lose my home or have to leave my job because I ccouldn't afford to travel to and from. They have taken inro account my bonus because I told them about it as I dont want to hide anything I want to pay for my children even though my ex partner will use the money on herself and refuses me to see them. Even ignoring the court order. Yhe CSA is driving me mad as they want it by DD but them funds will not be in my account once my mortgage payment has gone out.
Help!!! :mad:0 -
Hi
You need some short-term and longer term tactics.
Do we understand that you have mortgage on a property in which you are living (not one in which your ex-spouse is living)?
Can you take a lodger.
CSA2 for 2 children is 20% of your NET income after tax NI and pension; it is CSA3 which is based on gross income. Howeve rif you have arrears they can take 40%.
Is the sum they have quoted 20% of the net income for that pay packet?
Write and make a DPA request for all the details in your account. If you've have not made a mistake, you've made nothing0 -
I have never had to provide 1 single payslip when dealing with OHs CSA2 case.........It's always been 6 when paid weekly and 2 or even 3 at times, when paid monthly.Autism Mum Survival Kit: Duct tape, Polyfilla, WD40, Batteries (lots of),various chargers, vats of coffee, bacon & wine.0

I have told them about the mortgage on my property and they did tell me that they don't take any expenses into consideration it is based purely on earnings and nothing else. I feel like banging my head against a brick wall because I am getting no where. A lodger is not an option I'm afraid as it is a 1 bed flat that has no room for one.
My arrears now go back till the 28th July and at the amount they are it's 2 months salary straight just to get up to date. I asked for a letter from them with the details and how much it is but all they sent me was a D.D form and the booklet explaining how they worked it out. I will be calling them today and giving them my latest payslip details and requesting a recalculation based on this but all this time my arrears are building.0
