    You have given us completely different information on two different threads.

    If the debts about which you are talking are in OH's mums name, then your OH is NOT responsible for them.

    Did mum have a will?

    Who is the executor?

    If she has no will, who is the administrator? You mention a solicitor in the other thread, how is this person involved? Who appointed him/her?

    Did she have a death in service grant (you mention on the other thread she was a nurse in the NHS), was she employed when she died?

    Mums debts including the outstanding capital on the house will have to be paid from the estate by the executor or the administrator.

    Now coming to your own situation.

    If you are not working, get yourself registered for JSA urgently as that means you have some income even if it is a pain and you only get a little money.

    You OH may have become liable for Council Tax when mum died. If this is so, she needs to urgently claim CTB. This will be easier if you are on JSA as she can demonstrate your income levels.

    my OH tells me she applied for ESA, DLA, IS, and IB and was turned down for all of them unfortunately.

    also as far as I'm aware the solicitor is sorting out the Paperwork

    Why was she turned down? Has she appealed?

    What paperwork is the solicitor sorting out? Who appointed the soliticor? If the solicitor was appointed by mum as executor the situation is very different to if your OH asked him to do the work.

    There are two different problesm here and they are getting mixed up.

    1. Oh's mums estate and how the assets and debts are dealt with; which is appropriate for the probate and wills forum.

    2. The extremely difficult financial sitation in whih your OH and yourself are at the moment. Some of this may be as a result of your OH being orphaned and some as a result of her previous bad experience but right now it is important to deal with here and now and how to get things back on track.

    Please get OH to contact one of the debt charities; CAB ave very few debt advisors and she may find CAP helpful because they do home visits/face to face.

    In the mean-time well done both for trying to hold it together as the situation is very difficult.
