IPA Finish Date

Hi All, haven't posted for a while just been counting down the months for my IPO to finish. I went BR on 18 March 2010 but I received confirmation of my IPO on 26 Oct 2010 as I had been unemployed at time of BR. First of 36 payments were to start on 26/11/10 with final payment due 26/10/13...next month.
I have been unemployed up until about 4 months ago and yes I should have informed Moon Beever (Official Receiver's solicitors) but I didn't and thus haven't paid since my last Income/Expenditure submission to them which was when I was unemployed back in March 2013.
I have just received a new Income /Expenditure form to fill in and return to them and my dilemma is do I now declare that I am in work etc and supply all details or do I leave it as it is so close to the final date of 26 October 2013?
Any advice gratefully received I know technically I should respond, but....?

The legalities are that the or/ moonbeever should be informed of any change in circumstances. If found out I believe the repercussions would be unpleasant. You'll like have to back pay for the months you've been in employment if any excess exists. Why did you get a new SOA ? Surely it is for you to agree with your OR and moon beevor purely act as collection agent ?
I thought once your were discharged from BR then you don't need to inform change in circumstance - am I wrong ?0 -

I think if you're under an IPA/IPO (typically 3 years), then you still have to inform them of changes in circumstances (so they can reduce/increase payments) even though BR is usually discharged after 12 months.0 -
Thanks all, in answer to easygoingchap and just for information.......you are normally discharged after 1 year (and I was) but the IPO that you agree to during that year is in place for 3 years or 36 payments. When I decided BR was the only option for me I gave my job up as I was just too embarrassed and fearful that any money retrieving from the OR would involve my works (which it wouldn't in hind sight); also I did my research and this forum was great for advice. Effectively as I was unemployed at time of BR there was no IPO/IPA placed on me and my plan was to go through 12 months unemployed so no IPO/IPA could be placed on me.
I lasted about 4 months and just couldn't survive so I got a new job declared a change of circumstances to Moon Beever and acting for their client, the OR, I was asked to agree an IPO based on my disposable income after all expenses taken into account. During this subsequent almost 3 years I have been in and out of work and each time you (should) are required to inform (in my case) Moon Beever of the change of circumstances so that they either up your IPO amount or suspend any payments (when you are unemployed). It is normal for the OR to ask Moon Beever to send out an Income and Expenditure requests every 4 to 6 months anyway.
I have been a bit naughty during this time and not always declared situation, but in the main I have. I understand that after 36 months have elapsed regardless of what has been paid that is the end of it.
My issue is as that 3 years or 36 months is up next month do I bother to send in an updated income and expense form? I probably will as hopefully it will only be one months payment by the time they review it and that will be the end of it forever hopefully:) Hope this helps others anyway.0 -
do you mean an IPA as an IPO is when you do not agree and they take you to court and a judge puts an order in place.
either way it's a max of 3 years so you might as well do the right thing, as the worse that can happen is you have to pay a little extra for maybe 2 weeks, it's hardly worth the stress of not being straight with them.0 -
Hi Sniggins, thanks for your post, yes I meant IPA.....and agree with you I will declare my current employed status and go from there. I am just hoping that come 26th Oct the last payment date that will definitely be it!!:)0

chances are they will not even bother as by law it can't be longer than 3 years on an IPA so for the sake of a month they are unlikely to want to do the work involved. So no worries about it going past 26th Oct :j0 -

Our IPA states it is £x per month for 36 months and I am to inform OR of any changes in circumstances.
Interesting that the latest letter says to pay wilmot Clarke rather than moon beever so maybe different strokes and all that ........0 -
You could always be a bit slow sending the paper work back, they might not even bother sending you a reminder, if they do, you have lost nothing
Time they send the reminder, you return it, the time will be up anyway. 0 -

If at the time of BR your earnings are less than or equal your reasonable domestic needs, then the OR cannot get an IPA set up in the first instance, so you don't necessarily have to be unemployed.
If you continue earning less than reasonable domestic needs until the end of the 12 month BR period, then you will be discharged with no IPA in place. As you say, an IPA can only be imposed before discharge.0
