Bailiffs visit for someone else please help

  • The police have just gone and they were lovely. They're sending someone round this evening to photograph the bruises and take a copy of the cctv. They said to leave it with them and if I want to press charges they'll help as its clearly a case of assault. They also said they'd phone the bailiffs this afternoon themselves to get the details.

    I've also phoned my local councillor on advice of Moijisola who thankfully was both answering the phone and very helpful. He went strait to the head of council tax and I've received an email saying that the council have recalled the case from the bailiffs pending further investigation and apologising for "any embarrassment or inconvenience caused".

    Its a start. I know its going to take a while to resolve but jsut want it sorted. Thanks for being so nice. I feel pretty miserable to be honest. Also post just arrived with another letter for this woman - can I open it? Clearly no poinjt returning it to sender

    Also, it would be worth doing a check on one of the credit check agencies just in case anything shows up there which is connected with her.

    The council could not and will not care less, they send these people and they full approve these methods daily.
    This is a police matter, do not waste your time with the council, insist the thick half brained thug is prosecuted for assault occasioning actual bodily harm or attempted robbery which is what this is, if the police officer becomes afraid or starstruck, demand to speak with the duty inspector and make it very clear you will follow a complaint right through to the end if no action is taken.

  • Its from a debt collection company for a catalogue. What the hell is going on? Strikes me she's racking up debt and using our address. Wonder where the parcels are going to though

    will phone them and say she does not live here then hand the letter to police when they come later

    the letter has been legally delivered to the correct address, you have the right to open it, even if it isn't your name

    the bailiffs are not going to happy when he gets the call from the police and he will lie through his back teeth using the other bailiff as a witness to back up his version of events
    im very please you got this cctv looks like he wont be a certificated bailiff for long
    is he on the register of certificated bailiffs is he employed for the bailiff firm that is enforcing this debt

    If you speak to the council (if they phone you ) ask if they are employed directly by the council or an outsourcing agency

    councils don't administrate their own council tax collection and enforcement when you phoned the council this morning you spoke to someone employed by the outsourcing agency and if the bailiff firm in question is Equita or ross & Roberts then you can bet you spoke to a Capita employee the capita group of company's own both bailiff firms
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

    I would get the Police to press charges AND complain to the council (not simply your councillor) as its agents have forcibly and unlawfully entered your home and assaulted you.

    If you do not get a satisfactory response (and compensation) take the matter to the Local Government Ombudsman.

    You may not get compensation but you will cause a LOT of embarrassment which hopefully will reduce the chance of it happening again.
  • Police phoned. They've identified bailiffs in question and will be speaking with them tomorrow. Can't believe how lovely police are being. theay've not said it directly but I get the feeling they've had similar complaints about this particular bailiff but never had cctv to back it up!

    Councillor phoned me back as well. He's offering to help me with complaint process and has asked if he can come round tomorrow after I've dropped children at school. He seems a nice man glad I voted for him at last election now .

    Well, having CCTV and a bruise makes you in some ways a dream case for them. Not just words of two people disagreeing but solid evidence to use for prosecution.
