Got off the phoen to Triton - they said they can NOT remove the default record even if i settle. I said... whats the point in settling then? if you have chosen to mark it as defaulted even whilst negotiations are on going then what is the benefit of settling.. might as well leave it defaulted?
Does any one know if it IS possible to re-inform the agencies that is isnt defaulted?
If not maybe i offer a lower amount to avoid any CCJ on record otherwise cant see the point0 -

They can change it they wish to.
See the ICO stance on doing a deal like that here ---> http://forums.moneysavingexpert.com/showpost.php?p=62812348&postcount=4
Some creditors will even try to mislead you that they are not allowed to.
However, most will refuse on point of principle. I doubt you will have much luck, unless you can argue that the default is inaccurate or unfairly issued.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Fermi thanks so much. I have re-directed my letters from Natwest to Triton directly, informed them that the money is only available if they remove defaulted from the agencies. Will see what they come back.
Going to call debtline later to make sure they think it is ok to settle the partial etc based on them agreeing in writing not to chase me in the future.
Thanks all so much for your help.0 -
Need to be careful, as if they know you have the money might just go for CCJ.
Is the Natwest card pre April 2007?
If so worth a CCA request.:beer:0
