Capquest CCJ issues

Hi,

Hope someone can help me.

I have had a CCJ from Capquest in the passed that i paid off at the end of last year.

A month or so later i checked my credit report and it was still showing as active. So i called up the Court who said that they had not yet received a " Letter of satisfaction" from CapQuest and could not help me until they did.

I then called Capquest asking why this had not been done and the person who i spoke to couldn't help me saying they didn't have a record of it being sent but she would do it now.

Fast forward a month and the same story again. Still no letter received by the court...

This has happened 3 times now. I really need that CCJ to be marked as resolved. Is there any reasonable reason as to why cap quest are dragging their heals on this? And is there anything else i can do?

Its nothing to do with Capquest, its between you and the Court.

Did you pay the CCJ within 30 days of it being granted against you ?.

If you did then it will show as "Satisfied" on the Registry Trust website : http://www.trustonline.org.uk/

If you didnt, then then the Judgment will show until 6 years of it being granted.
  • I didnt pay it off with in a month no. I took out Cap quests monthly payment option and finally paid it off at the end of last year. The court said they had to get a letter from Capquest saying it was settled.

    Thats your problem then,

The CCJ was correctly issued and registered and Capquest *may* have fibbed to you.

Sorry this isnt the answer that you wanted.

You can apply for a certificate of satisfaction.

    http://hmctsformfinder.justice.gov.uk/HMCTS/GetForm.do?court_forms_id=1157
    Important

    1. Entries in the Register can only be cancelled if the debt
was paid within one month of the date of judgment. If the
debt is paid after one month the entry will remain on the
Register but will be marked ‘satisfied’.

    2. You must provide evidence that the debt has been paid
in full or state that the court already has this information.
The court will not be able to process your application if
it has no evidence that full payment has been made.

    3. If you cannot provide the court with evidence of full
payment, the court will write to the creditor to confirm that
the debt has been paid. If the court does not hear from the
creditor within one month, it will issue a certificate.

Ultimately, if Crapquest continue to be difficult you can go with option 3.

Best to deal with capquest in writing, and insist they respond in writing. Then there is evidence to send to court and/or Financial Ombudsman etc.

In this case the n443 is your way forward
