Capquest / h l legal solicitors harassment advice please!

Hi there ,
Haven't been on here for a while so I'm hoping I have the right answer or you maybe able to help , fingers crossed !

I have received a letter from h l legal solicitors regarding a credit card I had many years ago and too be quite honest I haven't paid for the last 6 years.
I'm pretty sure I haven't made any payments in last 6 years as I have checked my credit files and the debt I believe is statue barred very shortly within next 2 weeks!
The letter basically says take notice unless this account is paid in full or a proposal for settlement is received by 12 sept court proceedings maybe issued against you.
The debt is for £2000.00 after checking my files I think this will be statue barred on 14 sept as this was last date defaulted 6 years ago?
What would you do wait and then send a statue barred letter or ???
I just want rid of cap quest and I will repay at some point in my life but I'm not financially stable to pay this now. This credit card was taken out at a young age and unfortunately I am in a pickle.
I'm hoping you understand and can help.

Many thanks
Mr Dollar

    Hi Mr Dollar

The timing of the letter may be a coincidence, or it may be more than that. If your dates are right, then they can start a claim up to 14 Sept but not beyond (that's 5 days not 2 weeks). Obviously they're keen to talk to you to see if it is worth their while to pay to start a claim, i.e. could they enforce a judgement if they got one.

At this point almost anything is going to encourage them.

But are your dates correct? You say 'after checking my files I think this will be statue barred on 14 sept as this was last date defaulted 6 years ago.' So are you saying that the default date on your credit file was 14 Sept 2007? If so, the last payment should have been 3-6 months before this and the debt is therefore already statute barred. Have you any records that would show the date of last payment?

I would hang on for now. If they start a court claim you have a defence. If they are still hassling you at the end of October then you may wish to send a statute barred/not paying letter then. If you didn't make a payment after Oct 2007 then they must stop their activity.

Further thought: Have you just checked your credit file for the first time in many years? If so, that may explain the timing of their letter - they have just discovered where you are!
