Overpaid sick leave - can't afford to pay it back

Wow, on a public notice board,

Definitely get him to send you a pic.

Then go and have a half hour free with a solicitor.
I doubt seeing a solicitor will do that much but I do agree that the OP needs to wait until they formally request it.

They may just write it off.

  • Whoa - don't do anything yet.

What do you mean it's on the noticeboard?

Find out what is on the noticeboard first before you to anything or say anything to anybody.

When did you resign and when do/did you actually finish?

My friend said that there was just a notice on the board saying that I needed to pay £120 next to where everyone checks their shifts.

I posted my resignation letter on the 1st of July after speaking to my manager. This was 5 weeks notice for my last shift on the 9th of August. My sick note ran out the week after this. But when I spoke to my manager on the 1st I was told that I wouldn't be getting anymore sick pay. But at this current point the doctors have advised me that I should not be working in order to allow my foot to heal.
  • How long had you worked for before the accident?

Also have you looked into making a claim for the accident?

    It was 6 months.

No I haven't as of it. I have been trying to finish my dissertation and was told by one solicitor at the start of August that I had left it too late.

I guess its harder if you haven't collated the evidence but the time for claims is 3 years from the incident I believe.

If you have been there 6 months then you I believe would be entitled to statutory sick pay for 28 weeks so they can't just stop this.

They put on a notice board that you owe £120! - that is outrageous:mad:

You have only worked there for 6 months so probably have few employment rights.

What date did you actually resign and what was your notice period?

Had they already paid you for July when you resigned?

If they have over paid you in error the you should pay it back but the rate can be negotiated - if you can only afford £1 a week then tell them.

Id want something in writing eg from management or HR even to say you actually owe this money and putting it on a noticeboard isn't the best idea.

I sent in my notice on the 1st of July and last day of employment would have been the 9th of August. Notice period in contract was 4 weeks but I gave 5 weeks.

They had only paid me for two weeks.

I fully intend to pay it back but I just don't have any means of income to pay it back fully at the moment. Thanks.

Whoa - there is almost certainly a breach of one or other laws about posting on an open noticeboard that you owe them money. It leaves them right on the back foot. Get photographic evidence and take advice. Then approach them with your offer to repay steadily - if they kick off or demand it all at once, you have a card to play.
  • Do nothing.

If you receive a letter asking for the overpayment, do nothing.

Wait for the court action (if they bother) , then explain the problem. I doubt they would win a case like that as you were certified sick. I think the courts will take a dim view of this, since you have no rights and the issue could be taken as opportunistic.
