Debt agreement in place, BUT...

Hi everyone,

I have an agreement to pay a debt collector (Wescot) back at £10.00 a month, however, they have yet to take a payment.

The direct debit was setup on the 13th July with payments to be taken on the first of every month, yet to my surprise they haven't taken one yet.

I have had a letter saying they need my income and expenditure for their records (not my problem, they set the direct debit up without it, their poor planning does not constitute an emergency for me).

Do I NEED to do anything? I feel I have done everything I need to do by setting up the direct debit and I will do no more, can they take action against me for not sending them an income form?

(I remember on the phone, the call center lady said they could get into trouble for not having complete records, my heart bleeds it really does. :rotfl:)

  • Don't send them an income/expenditure form, they have no authority to make you do that. It might be worth contacting them and asking why the debit hasn't gone from your account yet, as per the recent agreement.

    I'd be tempted to cancel the DD and to set it up again as a standing order. That way you can be certain how much will go out your account and you can have control over stopping the SO.

    I wouldn't send a I&E. The only time you have to produce that is taken to court and a judge requests it.
