Underpaid for two years - Help!

Hi, bit of a complicated problem -
The company I have been working for since March '05 has just been taken over by another company. Yesterday I went for a meeting about my new contract and was informed I - like everyone else in the company - will be getting a pay rise. I was shown a chart showing me what I had been paid in the past before the takeover and what I will be paid now. HOWEVER, the chart stated my rate of pay under 'Probationary staff' - my rate of pay should have been 12p p/h more for the last two years. The thing is, this was after THREE pay rises. :mad: I spoke to my new manager about it just now who informed me that he is going to talk to my old company's payroll staff (who are still there until the merger is complete in a couple of months) but doesn't think I'll be able to get it back in a rebate.
12p per hour over two years adds up to quite a lot (I work only part -time but it still adds up to a couple of hundred pounds) and I don't think it fair that everyone else in the company was paid more than me just because someone stuffed up my paperwork.
If payroll refuses my rebate - what can I do? Any ideas? :confused:

    what does your contract of employment say you should be paid?- this is where you should start

    thats the other problem - when the old manager left everyone's contracts and personnel files disappeared. We don't know whether they were destroyed, sent to head office and lost by them or what. None of us were given a copy of our contracts either

    You need to ask to see your contract first of all.

    You should have your own copy of your written particulars of employment and should not be relying solely on the employer. Each time you had a pay rise you should also have received notification of the change.

    i'd try this query on the employment board - there are people on there who know lots more about this type of thing who might miss it here (and i don't really know what to suggest - here's hoping payroll give you a nice answer!)

    I was never given one! I'm started working there when I was only 17 having had only experience of working cash in hand before, so I had no idea about asking for a copy of the contract, etc. I thought it'd always just be on file with them. Also, nope, no notification of pay rise except in my pay slip which didn't really outline it - it was a case of spot-the-payrise.

    I'll post this again on there then, thanks for the advice guys! Hopefully I can get this sorted now!

    Hi,
    Do you have a trade union, they could help.
    If you terms and conditions have been transferred under TUPE legislation a trip to the CAB for advice would be wortwhile.

    Are you saying that what they thought you were paid, is less?

    I'm not sure why you think you've been underpaid - could you clarify, please?
