Response From Natwest to Prove it Letter

Hello everyone,
I am new here so please be gentle. I urrently am being chased by a DCA for £550 from Natwest bank which has accumulated from going overdrawn by about £15-£20
Now I know the debt is mine but i cannot bring myself to pay this due to the fact it is mainly charges on charges. I sent the prove it letter just for time wasting sakes really. The DCA have replied with a lot of pages of bank statements which I guess does prove the fact I went overdrawn and details the ridiculous charges applied.
Now they have proved it. What do I do next? I understand a CCA for overdraft is pointless. Is there a letter template to follow up with asking them taking me to court as there is no way I am pay this unless the courts tell me too.
Thanks for your help

Hi
No there isn't a template letter for that as its not usually a course of action that is recommended.
I guess you could stop responding to them if you don't intend to pay unless told to by a court.
Or you could write to them and tell them that you don't intend to pay unless they take court action and obtain a judgement against you.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
He long ago was this account?
You could make a formal complaint to the bank about the ridiculous charges. May Get some joy, may not, but stalls them for a while especially if you refer to FOS.
If close to 6 years since payment or acknowledging in writing then consider doing nothing.:beer:0 -
Thanks for your replies. Unfortunately no way near 6 years. Only March this year they stopped applying any more charges and complaining has got me no where either.
It was the final straw for me when they took money out of another account to cover the charges I complained about this and luckily got the money they took re-funded but they still want to £550 for the charges. So I stopped banking with them and now they have sent it to DCA to get the charges.
I think I may just ignore all letters surely the bank are not going to take me to court of a sum which 95% is charges.0 -
They'll not likely move straight to court, but the road likely leads there. One reason for this is that they don't want people to come to think that they can get away without paying, as it could lead to many more people just ignoring charges.0

Did you refer your complaint to the FOS?:beer:0

It sounds like the OP stopped banking with them some time after March this year. Assuming they still paid money into the account does this mean that there was some payment towards the debt until the last time money was paid in?loose does not rhyme with choose but lose does and is the word you meant to write.0

dont say to a DCA to take you to court as look bad on the judgement , if you want to pay the £20 do it to the OC , and get them to remove all the fees on the account , so then u have a settled default , still same as any default but they wont chase anymore .
most peoples high defaults are from charges interest and fees from DCA aswell thats why its best never to pay them the DCA0 -

Follow the process in this guide, Write direct to the bank and tell the dca to cease collection activity as this is a disputed debt.
Bank charges
That way there is a chance that this will be written off and they know that you would defend a court claim if they made one.0
