  • On reading all the posts a few things pop out to me.

    The police involvement may be a belts and brace approach. Due to having the NHS, social services, and the university involved the investigating officer may want to ensure that the investigation is done thoroughly.

    I have worked with many supported people where the approach of pouring water over their head is part of an agreed care plan due to physical as well as behavioural needs. It may not be the most pc way but if its in the interests of the supported person its agreed. No one can really comment on that aspect as we do not know the supported person and what one op said about covering eyes and nose etc may have caused difficult behaviour.

    I dont know the POVA system that well but in Scotland, ASP procedures may at times automatically involve the police. Get a copy of the policy and procedure being used be it NHS or social services.

    Don't rely on procedural flaws with this as it won't make a difference at a tribunal as they would just have to evidence that the same outcome would be applied if proper procedures where followed.

    Its a difficult time but there isn't much you can do except get legal advice so you are prepared.
  • Thanks for your messages. Just a quick update on what's been happening. I was interviewed under caution as they could of charged me with common assault. My solicitor was really helpful and told me that the police had spoken to the other two people suspended and that the police had visited work and could see the way the patient behaves. The police called me today to say that no further action would be taken on their part, but work may still carry out their investigation. So I'm just waiting to hear from them now. The way we shower the patient is the only way we can do it in a safe environment for staff and the patient.
  • It's not far fetched, the accusation was that I poured water over a patient whilst he was in a shower to get the soap off.. That's all it is.
