Court Action

Hi all

I have recently paid all outstanding debts off, all were defaulted accounts with mobile phone companies from when i was a teenager (well 4/5 years ago).

However theres 1 thing left defaulted which is a Littlewoods account. Basically i ordered a guitar at the time on credit for £143, it arrived broke and Littlewoods refused to let me return the item, even though i know they had to let me return it they wouldnt accept it so i never made a payment on the account. Right or wrong thing to do but i wasnt paying for something that was useless.

The account was set up in Jan '08, never made a payment but it has it down on my credit report the date defaulted is May '10... This cant be right? Over 2 years to default me.

Anyway i've had all the usual calls and letters from Moorcroft, Lowells ect... For years. About a month ago i got a letter from a solicitors regarding this account basically saying pay up or your going to court, i thought they were trying it on again so ignored it, a week later i recieve a pack from Northampton? county court that the solicitors were claiming for this account and i had 14 days to reply, either make payment, defend it or submit an offer of payment.

I registered online to the court and filed a defense not aknowledging the debt, and that they'd harrased me ect.. All i was doing was bying the time so i would have been paid and had the money to pay if a ccj would have been placed on me.

I recieved a letter saying my defense had been sent to the solicitor and they should reply within 28 days. 30 days later a letter comes from the court saying the case is now 'stayed' in court as they had not responded within 28 days and if the claimant wants to take it further they need to get the stay lifted by a judge.

Few days later a letter comes from solicitor saying lowell want to take this further and they'll apply to my local court. Since that i heard nothing from them, however i now have 'Fredrickson International' chasing me for the same debt, phone calls and txts every day about it. Told them whats gone on but they wont have it.

Can this new company now chase the same debt thats been stayed? Any advise what to do next?

Also original debt was £143 but they now want £465!

Not really sure what my options are here, was hoping to get it statue barred by holding them off if i could.

  • Default should be a max of 6 months since none payment. Complain to whoever registered the default. In writing, signed for. Not sorted after 8 weeks then refer to FOS.

    Who owned the debt when stayed in court?

    I would send a debt sold while in dispute letter to Fred Int. google will find one for you.
