bankruptcy question

quick question.. I have been separated from my husband for 3 years but still legally married. I financially disassociated myself from him through experience when we split. I'm going bankrupt in September after paying a DAS for 2 years, he is worried that he'll be chased for the debts because we're still legally married? Is that right?

    The debts are all in my name, nothing connected with him.

    If the debts are all in your name, and your name alone, then no one else is liable for them.

    It doesn't matter what your marital status happens to be.

    Even if you hadn't financially disassociated yourself from your ex, he wouldn't be liable for your debts.

    Also, if he was that worried about being liable for your debts, you'd have thought that he'd be getting some kind of advice for himself. Not leaving you to sort it out.

    Maybe you should charge for your time? ;)

    If you have any joint debts then they fall on him - otherwise he has absolutely nothing to worry about.

    You don't acquire debts of your spouse upon marriage.
    No free lunch, and no free laptop ;)
  • forgot to check back on this, I heard back from my financial advisor (couldn't get hold of her when I wrote this) she also confirmed that he will not be liable.

    I told him to find out himself if he was that worried! Was he new gf that 'knows about these things' that had told him...she clearly doesn't lol!!
