Sorry for the long post.
My husband is self employed (in construction) and has been using a supplier and over 8years he has bought nearly 500k in materials from them.

Situation now... and he owes the supplier 23k. A customer of his went into receivership owing him 38k and now the supplier is chasing him for the 23k.
The invoices are related to 2010.

The supplier is actually saying it is 28k but we are owed a credit note for the difference.

Upto year before last he has been paying anything form 1k to 3k from our savings an top up mortgage.

Since last year he has been sending the suppliers 100 per month as work is very slow and money is just not there to pay the bill. Last year he received only letter from the director of the company asking why the traffic has only been one way and they wanted the 32k. (husband bought no stock from them).

My husband wrote a letter back saying that the account was on hold and they would not supply to him and that he was on labour only so could not reduce the bill quicker. He explained that he was owed a credit note for 5k for the last 4years. The director did not know this.

Every month without fail he has sent a cheque. He spoke to the director a few times.

Now in January a letter arrived from the companys solicitor going for a civil bill for 28k. We engaged a solicitor and he has been in discussions the last few months. in May the company said they would accept 14k which we do not have. We offered 7.5k full and final or 4k per year for the next 5years. we heard nothing.

Now...the company solicitor has informed our solicitor that the are processing with the civil bill for 28k. the company solicitor did not reply to our solicitors letter but with a letter chasing a civil bill.

1)If we get a loan and pay the 14k full and final what happens to his credit file? Will anything be written on it about the balance and how long it is there for?
Thanks everyone for your help.

2)Is it worth paying the 14k or just let the civil bill go its course? My relation is trying to get the loan for him as we can then pay that back over 4-5years.

He has been paying 100 every month since the start of it. Every month he receives a statement with the amount outstanding except the 100 that has been paid.
In the lasts 6months we have engaged a solicitor that a friend of my husband used with the same supplier. Supplier was after him for money as well.

We cant afford to go to court. barristors and solicitors fees are adding up.
They threatened that my husbands name will be in the Stubbs Gassette which they put his name in it. Brilliant but at this moment is really not going to make a difference as noone can get credit.
We are in Ireland but the law in England applies here. Same with peoples credit files.

We are just paying heavy mortgages and bills. We have no life the last 4years. We are just serviving at the moment.
